    • On the other thread you posted on, you asked about immigration issues. We aren't qualified to give that advice, sadly, you would need to find an authorised adviser. 'It is a criminal offence for a person to provide immigration advice or services in the UK unless their organisation is regulated by the Office of the Immigration Services Commissioner (OISC) or is otherwise covered by the Immigration and Asylum Act 1999. Members of certain professional bodies may give immigration advice without registering with OISC.' How to become a regulated immigration adviser - GOV.UK WWW.GOV.UK

    • Met are out of order in this new version of their PCN. They show your car arriving and leaving via the ANPR cameras. They then go on to describe this as the parking period knowing full well that since your car still has to drive to a parking space and later drive from the parking space to the exit. How this can be described as a parking period with so much driving involved is beyond me.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I changed my house phone a few months ago and keep getting constant calls from these people for someone I never heard of. I keep telling them this person does not and never has lived here.

Now they keep sending recorded calls asking me to call a number to arrange a home visit.

This is getting annoying as I am getting them 2 or 3 times a day.

Typical tactics from MMF. They've probably sent out dozens of messages to dozens of different people hoping to get a bite.

Send http://www.consumeractiongroup.co.uk/forum/showthread.php?387367-Harassment-by-Telephone and a very sternly worded letter to rob sands - MMF compliance officer. Also have a good read of harrison vs link.

It has been said " mysterious Mike" is the door stepper, collections manager, office boy, tea maker of this outfit

Make sure that the letter is headed Formal Complaint For the Personal Attention of Rob Sands.

I've written so many to him over his career in debt collection with MMF and Mackenzie Hall (the Kilmarnock Cow Boys).

Has anyone ever gotten a reply? it's also suspicious that MH was acting like MMF are now until Sands left. Now MMF are acting like MH used to, while MH has gone pretty quiet.

PFA seems to have had a "calming" effect on MH perhaps it's the US influence??

MH were imo never as crass as MMF is now.

It does seem that whoever is actually " pushing the buttons" on MMFs threatogram machine has totally lost the plot ( if they ever had it of course!!).

Whats more concerning, to me at least, is that Action hasnt been taken against them yet about their business practices. Either by the regulators or by a debtor.

I believe we will see results once the FCA is fully in control of the "industry" more teeth and instant action not waiting for licence renewal before acting.

Well I doubt Mike the door knocker will come knocking here as I have lived here for 9 years and I am sure its only the phone number he has. Stupid outfit these are they not. Wasting all this money on phone calls to the wrong person .

Closed minds, brains in "computer says" mode so the "MUST" have the right person!!
