      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I would be grateful if you could keep me up to date on any success with the Ulster Bank as I am helping a friend claim back just about £2000 of charges - also I am claiming myself against the Bank of Ireland and it would be interesting to learn the outcome of a northern Ireland bank in court.

 

My friend submitted her request for refund and a schedule of charges about 2 weeks ago and received back within 5 days a refund of £90 (big of them, it only leaves about £1900). I then submitted for her the 14 day letter and so by this day week, if nothing is heard, then we file for court.

 

So let me know if you can and if you know of anyone who won against the Bank of ireland, let me know.

as far as the ulsters concerned they seem to settle as soon as they receive your court papers so roll on the 14 days until you issue your or your friends claim unfortunately the B of Ireland seem to be playing hardball read PMcMurrough threads.

If you have to get as far as the court bit do you have to pay court fees.. or do they only get aded when you actually get to court?

 

Also, when you get to the court stage you add the intrest on.. does that mean if ulster bank want to pay you out of court at that stage they will pay you the intrest as well?

If you havent already you should start your own thread cause its good to get advise and info from others on the site. You will be able to help others as i have found on this site it goes slow and each case is unique. It helps to get the odd we comment or ?? to keep you going while you wait.

Hi, stuart happy new year. Im in the same place as you just about to lodge my claim against UB. They refunded me £270 before xmas and they still owe me over £2k. Let me know how you are getting on with your case. S.

yes ! a few and a few more just starting the process ! type ulster bank into the search button and all the cases will come up ! one thing i will tell you to do is make sure you read up on the process before you start so you dont make any mistakes there are tried and trusted ways being used here over and over again without fail and if you follow these you too will have a successfull outcome any problems just ask here someone will be along to help you and for yourself start a thread of your own and it will make it easier for you to follow your progress good luck !

The Ulster Bank owe me more than £2600 so I am trying to do my small claim in 2 lots - can anyone tell me how to work out the interest properly - is it *% of total or8% a day and how do I work that out?

Sarah there are spreadsheets in the templates library which work the interest out for you ! of course you have read that you can only add interest on once you have issued court proceedings then its actually 8% on the total and then 8% per day untill they settle ! I used the english version of the speadsheet for excel its pretty easy to use just read the instruction you will need all your charges in front of you to add them to the spreadsheet it totals them all up for you so you can send them to the bank involved and has a seperate button which when pressed totals your interest up ok ?

mcvey how far did they take it ? did they have to issue court proceedings ? was there any defence or did they settle without putting a defence in ?

Hi All

I have been up to my eyes since new year with work so haven't done any thing yet . Am about to lodge my mcol so will post any results on here. Just to update though i had explained the process to a few guys in work and to date one has received £500 from the halifax and another's sister has just got £4500 from the bank of ireland.
