      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm so glad you are back with us.

 

You are never alone, and we're all on your side, but sometimes for various reasons we aren't online for a day or two. :juggle:

 

And I personally just don't have the experience of fighting anything like this.

 

The Mould really is your hero.

I do understand that some days are worse than others. We all feel like that. You, me, and The Mould.

 

I was in bits yesterday and howling. We all have low days.

I think you have done amazingly well for yourself (with help from The Mould, of course).

 

I share your frustration with the Courts. I have been trying to issue a claim for over a week.

 

Wednesday: Car problems, so had to go to the garage instead of Court.

Thursday: Like you I went to the Court in the afternoon and didn't know that the counter service now closes at 2.00 p.m., instead of 4.00 p.m.

Friday: Went to Court in the morning only to be told they don't now handle money claims at all and I have to send everything to Salford.

 

Then I discovered I didn't have any cheques left so had to order a cheque book. (A postal order would have cost £12 - total rip off.)

 

I'm not quite certain what the Courts now do for the £95 they charge to issue a claim! They are certainly not providing the service they used to when a claim cost only £70! :mad2:

 

I hope you managed to get it done this morning.

Hi Wendy,

 

When I first joined CAG I just couldn't understand why there were any funny threads. I was here for serious advice!!!!!! But then I noticed that someone from a thread I was on had posted so I had a look and within seconds I was laughing my head off. When you are feeling miserable they can really cheer you up so it's well worth looking in the Bear Garden for some light relief. :lol::lol::lol:

Sometimes when there is a "squabble" on CAG it is because there is history on other threads which followers of this one may or may not know about.

It does weigh a ton, doesn't it? When I had a court case a few years ago I found it was cheaper to drive everything over rather than post it, and that included parking fees too!

 

I am on another thread talking about the likelihood of DCAs taking action and I have posted a link to your thread as a cautionary tale to show what can actually happen if Lowell take you to Court. I've also said how amazing you have been at learning to deal with all this stuff in such a short time, with Mouldy's help of course.

 

From the days when you first posted you have done incredibly well. You have worked hard to get your head round all the legal stuff and it must have been spinning at times. You should be very proud of yourself.

And I meant every word. We are all happy to help where we can, but this is a self help site and it's obvious you have worked hard to learn from the advice you have been given. I sometimes see new posters coming here and they expect every chapter and verse to be quoted for them and it never seems to occur to them to even look at another thread to see what information they can find out for themselves.

 

I'm not talking about all problems, btw, because some situations are very tricky, especially benefits and bailiffs where people are in desperate situations, I'm talking specifically about credit cards (straightforward issues - not nightmares like yours!!!!) where once some advice has been given they really should be looking at some threads and doing some research for themselves, then coming back to the thread with their own thoughts and questions. Then we can give more help and are happy to do so.

 

I have learned everything from CAG and I'm willing to help anyone but it's absolutely wonderful to see someone like you who is really fighting too. That's why we are so proud of you.

Thank you for your good wishes. I wish the very best possible for you and your family in 2014. I know things are very difficult for you and your family.

 

Have you had a firm diagnosis yet? I know you may not wish to say what this is on the open forum, but I remember last year that you were still having tests.

 

Despite everything you and your family are going through you continue to give so much hope and support to wendyboats, to me, and to many others on CAG. I know we are all rooting for you too.

I see you were burning the midnight oil and I hope you are getting enough sleep as I know you have to be up early for the school run.

 

I think it is a great idea - but only when it's over and you have won your case. They have behaved disgracefully throughout and it would be good to expose how they have treated you especially bearing in mind that the only way they could get you over the £750 bankruptcy threshold was to lump three debts into one claim. I'm sure DCAs do this all the time and I expect they get away with it more often than not as a lot of people will not know that they shouldn't be doing this. That knowledge alone would help a number of people I'm sure.

 

The fact that they can go from a dodgy claim to charging so much in costs that you could lose your house is absolutely chilling.

 

Anyway, who knows? You could become a celebrity after the programme and you'd have producers rushing to sign you up for "I'm a Celebrity...", "Strictly", "Come Dine With Me" or even "Splash!" if you look good in a swimsuit. :lol:
