      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

put the service as your local branch - don't put a date when your account started if you don't know it .. just change it to .. I have an account etc etc .As for customer services telling you when your account opened , they told me 1957 ,I wasn't even born in 1957 :p .

to be honest I would advise that you don't do moneyclaim if the court is local to you then do the N1 form taking 3 copies of it and 3 copies of your schedule and hand it in personally.Moneyclaim is restrictive in how much text you can put in .

 

NO there is no human rights issue and Yes you have to add the text.

Just checked the moneyclaim site, and it says the claim has been issued today(24/07/06).

It says:

Your claim request has been accepted. The Defendant has 14 days from the date they are served with the claim, to reply.

 

What happens if they don't reply after 14 days?

hi I too have had acknowledgment of service the claim was served on 31st July and got acknowledgment on 4th August. so do they get 28 day from 31st or from 4th? P.S good luck with your claim. P.P.S how did you get the detials of your clainm put under your threads?

Hi Rjh & jadest,

 

If you check the notice of issue, which you should have received from the court, it will tell you when the claim was deemed to be served.

 

This is usually five days after the date of issue, and is the date from which you should begin to count the 28 days (in the case of Lloyds acknowledging your claim).

 

My claim was issued on 19th July, deemed to be served on 24th July, acknowledged on 25th July and the 28 days were up today!

 

Accordingly, I've now asked for a judgement by default, although I wouldn't be surprized if Lloyds still manage to file some sort of defence to stall things further.

Hi Rjh,

 

Well, as predicted, good old Lloyds didn't let me down!

 

They filed their defence at the very last minute, as they seem to do with everyone else.

 

The pettyness and unprofessionalism of such a large organisation, clearly demonstrates the disdain with which they regard their customers.

 

How they can justify abusing the legal system time after time beggars belief!

 

At least, now, fellow CAG members are aware of Lloyd's tactics and won't allow themselves to be bullied or fobbed off into submission.

 

Going away for a few days now, but I'll keep you posted via my own thread.

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

not sure what happens next reading the other threds on here the trend for LlyodsTSB seems that they take it further you will recieve an allocation form to fill in with extra cost, and then they usually leave it till just before court date to offer a settlement.
