    • It was a facebook post. The number he lives at is 41, he had 5 other cars, and another van all packed into his front garden. He also had a tow truck parked out side. All the other cars and van looked in very good condition. So I'm assuming he is a back street dealer.  
    • Okay. I suggest that you begin by getting a written confirmation of the evidence you have – in other words a written statement from your customer confirming that he did order from you, what it was she ordered, how she paid, that the delivery failed even though she waited in for XXX days. Did she receive any email notification of the forthcoming delivery? If so you want to get hold of a copy of that. Did you reimburse her? Confirmation from her that she was reimbursed by you £XXX. Any other evidence you can get all statements from anybody – get it in writing. Get it now so that you are fully prepared and you don't need to go back and ask later after you have committed funds to bringing a claim. Draft a letter of claim setting out your case and what you are asking for – and a timeline of 14 days after which you will issue the claim. Don't expect them to respond to this with any thing positive. This is simply a formality. You aren't bluffing. On day 15 you will issue the claim. If you have any doubts and we stop now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Firstly I would like to thank the community of CAG as it has got us out of a mess a few times.

 

Currently; we are dealing (or in our case - not co-operating) with Scotcall.

 

On all their letters they put only a 0844 number, their non-0844 number is: 0141 248 7400.

 

It won't let you do 141 in front but I called and made sure that I said I didn't want correspondence from them except in writing.

 

I did of course deny any knowledge of the debt and demanded a copy of the original CCA (which I doubt that they have.

 

Wescott (The original DCA offered a 50% discount on the debt on the second letter which tells me there is a good chance of them not having the full paperwork.

 

Just though this may help people dealing with these.

What type of debt is this e.g credit card, catalogue debt ?

 

Is the debt on your credit record ? You should check and if it is not showing, could it be statute barred ?

We could do with some help from you.

Hi

no unfortunately it was originally it was with greenwoods (provident personal credit) a couple of years ago

 

background is

Not long after, everything went pear shaped husband became disabled since then loads of debt

 

last year I had a heart attack at the age of 43 due to stress from a loan company (secured loan on house threatening repossession

even though house is in negative equity)

 

house finally repossessed early this year

 

husband also went bankrupt in April.

 

best thing that could have happened as it has taken so much stress off.

 

 

started getting letters from wescott few weeks ago didn't reply+

 

in there second letter they offered to reduce the total amount owed by 50%

 

thanks to this site I realised this meant they may not have all the paperwork (confirmed by a friend who happens to be a debt collector)

 

decided to request a CCA and see what happens.

 

I know this may sound mad but we have nothing left to loose other half is on means tested benefit and Bankrupt.

 

My only income is from carers allowance and child benefit so I know that if they go for a CCJ (my credit rating is already in the toilet)they will only get a token amount.

 

I have decided to have some fun and give them the run around as payback for all the stress they caused as they are not the only creditor.

 

the worst one is central credit who we had a secured loan from even after we sent them a estate agents valuation

which proved the house was in negative eqety

 

they were still demanding £600 per month or face repossession (recently admitted that when house is sold they will have to accept £1 per month

for the shortfall of £47,000 as my only income is benefits) .

 

I would just like to say thank you to all the people on this site as it only because of them and there advice that I have the knowledge and confidence to be able to deal with these people

Did you make a formal CCA request and send the required £1 statutory fee?

Is this on your credit files you need to check if you haven't done so.

I made the request over the phone but I will now put it in writing what would be the best way to pay the £1.

 

yes it is on noddle (double checked this morning) still under provident don't think it is on any of the others.

 

strange thing was the joint secured loan with central trust wasn't even though we have had a copy of the original contract.
