Hi, I have just started my claim with money claim online. I have gone down the usual route and basically been told where to go. Just one thing worrying me, all letters I have sent to Lloyds tsb have mine and my partners name at the top of the letter, as I have an account on my own and a joint account with my partner and im claiming charges on both. However it did not give the option on money claim to include another person, so the claim is me v's Lloyds with no mention of my partner. Could this be a problem? Any help is much appreciated.

Thankyou for that, think ive made a bit of a mistake on the claim form, ive included the interest in the particulars, but not included it in the box at the bottom , so the Totals box doesnt include the interest. Sure the court will be ok with that. Ive also sent a schedule of charges to the court recorded delivery, and another copy to the bank, this time showing the interest. I put a covering letter in with the schedule basically saying I can now confirm I have started a claim against you, I enclose another copy of the charges schedule which you already have....blah blah. So its sit back and wait time.

Just one question, on average, what usually happens now?? When do they pay up and has anyone actually ended up standing in court??

Lloyds TSB have acknowledged my claim and money claim has sent me conformation of this. The banks solicitors are Sechiari Clark and Mitchell and on the acknowledgment of service they have stated that they intend to defend all of this claim. Is this normal????

Thanks for that. Also, rang moneyclaim about the bo**ok I dropped on the online claim form (put the interest in the particulars but not in the totals box) they say I have to fill in an N1 form and a N244 form and send it to the court with a £35 cheque to amend it. However, just printed a N244 form and its an application notice. Just cant see how that is relevant to simply changing an amount, think they have told me to fill in the wrong form.

Top left hand box:

 

1. Tick c), without a hearing

 

Leave the rest blank

 

Part A:

 

I ***** (the claimant)

 

(that....) allows an amendment to my claim in respect of total claim value

 

(because....) the claimant omitted S69 County Court Act 8% interest from the total calim value

 

Part B:

 

tick 'evidance in part C' box

 

Part C:

 

Something like;

 

"I respectfully request that the court allows an amendment to my claim in respect of an increase of the claims value only. The S69 County Court Act 8% interest is included in the Particulars of Claim, but was ommitted from the total claim value.

 

Please find attached to this application my proposed new N1, amended to represent the increase of the claims value, as well as a schedule of the amount claimed in respect of penalty charges levied by the defendant"

 

 

 

Send 3 x N1 + N244 to the court along with the £35 fee.
