    Help Please

    Hi, I am currently helping my parents to claim charges from abbey. They sent off the first letter, with a charges schedule, and they have replied saying that they will investigate the complaint, but it could take up to four weeks. I realise that this is a delay tactic. What I want to know is, should they still send the LBA after the normal 14 days, or wait until Abbey replies again, with a standard sod-off letter which could be 4 week?? Any Help much appreciated.   2. Hi GuidoT, I have just recieved my AQ, and have filled it in the old way, so without using a gallon of tipex and making a real mess of it, I cant really add the draft order. Is it still ok to go down the old route??
  3. Hi, ive just recieved a copy the defence from the court with an allocaton questionaire, which I have filled in. They have also transfered my case to Barnsley county court where I live. I am going to send the AQ to Barnsley, the solicitors for Lloyds are Sechiari Clark and Mitchell, who are based in Brighton (other end of country). Does that mean, one of their solicitors would have to travel all the way up here to Barnsley for the hearing?? Just want to know what usually happens next?? And am I likley to have to stand in court?? I have followed the procedure given on this site, down to every last detail. Any help much appreciated. Andy
  4. I haven't bothered with the overdraft interest. Ive just used the simple spreadsheet. Im happy to recieve 8% on what they have charged me. Its a bit of a headache going down that road.

Also, rang moneyclaim about the bo**ok I dropped on the online claim form (put the interest in the particulars but not in the totals box) they say I have to fill in an N1 form and a N244 form and send it to the court with a £35 cheque to amend it. However, just printed a N244 form and its an application notice. Just cant see how that is relevant to simply changing an amount, think they have told me to fill in the wrong form.
  7. Lloyds TSB have acknowledged my claim and money claim has sent me conformation of this. The banks solicitors are Sechiari Clark and Mitchell and on the acknowledgment of service they have stated that they intend to defend all of this claim. Is this normal????

Thankyou for that, think ive made a bit of a mistake on the claim form, ive included the interest in the particulars, but not included it in the box at the bottom , so the Totals box doesnt include the interest. Sure the court will be ok with that. Ive also sent a schedule of charges to the court recorded delivery, and another copy to the bank, this time showing the interest. I put a covering letter in with the schedule basically saying I can now confirm I have started a claim against you, I enclose another copy of the charges schedule which you already have....blah blah. So its sit back and wait time. Just one question, on average, what usually happens now?? When do they pay up and has anyone actually ended up standing in court?? Thanks in advance for any help. This site is a godsend.
  9. Hi, I have just started my claim with money claim online. I have gone down the usual route and basically been told where to go. Just one thing worrying me, all letters I have sent to Lloyds tsb have mine and my partners name at the top of the letter, as I have an account on my own and a joint account with my partner and im claiming charges on both. However it did not give the option on money claim to include another person, so the claim is me v's Lloyds with no mention of my partner. Could this be a problem? Any help is much appreciated. Andy
  10. Just been on holiday, and ive had TEN returned Direct Debits, the largest value was £17.50!!! £350 in charges to come out on the 2/10/06! Thats an all time record. Phoned the bank, they wouldnt budge and put me through to customer support unit, oh that was after they tried flogging me some insurance!!!! I couldnt believe what I was hearing!!!. They wouldnt waiver one single charge, all the cheeky b***ards offered me was a loan to cover the charges. Told him to shove it up his a**e and I wasnt over concerned as I will be claiming it back. He asked how, and I said that I was taking the bank to court because the charges were illegal. He didn't argue.
  11. Best of Luck to you. Exciting stuff isn't it. The thought of shafting your bank, like they have you over the years is almost as good as getting your money back! The banks love people like me and you and all they do is kick you when you are down. Ive had it with them. Whats funny is, people say "put your money in your bank so you wont lose it"! The fact is, its the worst place to put it because they just loot it! Im keeping mine under my bed in future, along with a large bat!

Hi, I really wouldn't worry about going slightly over the six years, because when you first asked for the money back, you were with-in six years, and it is the banks response time that has taken you over. As regards the interest, Im not sure so I wouldn't like to advise. Im sure someone can help you there. Best of luck!
  13. Will be bad for my health if I win though, because if i win, I will go on the biggest bender and spend all the money up the wall and end up back where i started!!!! Will be fun though! Haha!!
