    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'd say go for early 2001 too. Good luck with it all .... be prepared to be ignored & fobbed of at first but you will get there in the end.

 

Well the luvly lady called back but I'd gone shoping with Ma in Law! She left a message on a/machine for me to call her but it was too late when I got home so will call her 2moro - This should be news on my cont interest CQ! I'll keep u informed! :)

OK update time ... called the luvly lady today but she was in a meeting - a colleague asked if she could help but then said she didn't deal with charges. She did read the notes though & confirmed that HQ HAD AUTHORISED :D payment of the other charges so that's good news eh!! There were no notes about if a cq had been raised but she said she would pass on the message that I accepted the payment (as if I wouldn't) & that I requested a CQ to be sent. i asked for her to call n leave a message if there was any probs as I was going out.

 

Nothing on a/machine when I got home so there must be no probs eh ... be watching the letterbox for the cq for cont int then! Not may £££'s but just enough to pay for my next court action so that's enough for now eh! :D:)

This looks like the final formalities before they issue the cheque, doesn't it ? Be on your guard, tho, Chez. If they want to speak to you before sending it, then it sounds like they might be trying one last-minute move at getting you to accept less than you claimed. Ms Nicey might make you feel so horrible at refusing her offer of 2 quid, a bag of sweeties and a grovelling apology, that you'll say "OK then" without noticing.

 

I'm sure you'll know what to say, but if you get cornered, try summat like: "Look - I appreciate what you're saying, but this has been a long and difficult process for us, and I'm going to need some time to think about your offer and talk with hubby about it. I'm sure you'll understand that I can't just accept this without asking him first. Can I have your name & extn. & we'll get back to you."

 

The "we" bit plants the picture of an irate hubby yelling at poor Ms Nicey, and leaves her to stew on that image for a while !!

*Yippeerdeeedooodahhh Yippperdeeeyaaaayyyy!! My lil cheque arrived today!!!* Only sixty squid but this marks my FIRST TOTAL WIN! Yaayyy!

 

This was the cheque for the contractual interest I charged on my claim so I'm well chuffed!! Means once cleared I can use on me court costs on another claim eh! ;)

Im currently dealing with Creation and have had a letter today which looks as though is responding to my Prelim (even though I sent LBA on 27th Jan).

 

They have offered me part payment with part interest and the letter goes on to say "this concludes my investigation and if you remain dissatisfied, you can refer your complaint to Finance and Leasin Association blah blah"

 

I just wondered if you had this in any of your letters as Im not sure what Finance and Leasing is?

I did have that paragraph but it was on a letter saying they were still dealing with my complaint & would contact me again within 15 days ......

 

Don't worry about it too much - Just send a letter accepting the offer as part payment & remind them of your deadline & stick to it ... They WILL pay you ... I didn't have to get anywhere near the courtroom on this one & a 'final demand' type letter did the trick!

Ive enclosed a copy of LBA that they didnt have with my rejection letter. Fingers crossed they pay up...although the interest is about 3 times the amount of the charges!

How did you work out the interest amount on just the penalty ?

 

I am using a spready that Bill emailed me for my Nat West claim as I cant manage to dowload Mindzai's spready:confused: ,would another spready be more suitable for this purpose ?

 

I would like to get all my money back cos Creation are the pits !

On quite a few of my statements it shows a late payment fee,an unpaid direct debit fee and a returned payment fee,so thats £42 in charges for 1 statement !

 

I would appreciate any help you can throw in my direction !

I intend to claim for missold PPI and CI on top of the charges, and reading your thread ,it looks like you also claimed for the interest.
