    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cheers guys! Bill if I re-send my LBA then I'm giving them another 14days aren't I? Don't really wanna do that as I never got a response to my letter on 2nd November refusing their settlement & I just sent that normal post ...

 

Oh I will ring Royal mail anyway but am tempted to just do as TC says & proceed as if they've received it ... pity I can't get hold of an e-mail address as I could send a copy as a 'gentle reminder' eh!;)

Chezt - sorry - didn't explain myself.

 

Send them a copy of the ORIGINAL LBA, with original date. Stick to your schedule, but in the event that the Royal Mail did truly f**k up, then you have meanwhile set the clock ticking ASAP.

 

While they're all faffing around checking this that & the other, then at least you have not had to put everything on hold until they finally come up with a result (3 bloody months down the line)

 

If the worst comes to the worst, then you can give them 7 (yes 7) days from the date they received your LBA copy. Whereas if it turns out the original was never delivered, then you might not be able to start the clock again until they've eventually said "sorree" and forced you to send a copy of the original LBA anyway. I really do suggest - do it ASAP - it's a"belt & braces" strategy.

Ok get ya! Wish I'd thought to check for a signature sooner 'cos LBA expired Yesterday ... :mad:

 

Interestingly enough I also sent two others on same day - one to Yorkshire Bank which has a signature & one to RBS Visa again with NO signature (this was my LBA but I'm deffo not re-sending that one as I've since sent 2 letters telling them exactly when I'm taking it to court so though if they haven't seen the LBA on that one & u know the parlava I'm avin with them!)

 

Other prob - can't re-print n resend today - will av to be 2moro - don't have time before leaving for work now GGrrr I'm so annoyed! :-x

No, we don't tend to check for signatures, do we ?

 

Send them the copy of the original (expired deadline) LBA, with original date. Don't tell them that you don't have a signature - they probably did get it, and the postie just didn't do his job and post details when he got back to the office.

 

Give them a further 7 days in your covering letter, and politely but firmly insist on an acknowledgement from them, by return of post, of the LBA. That at least, then gets you a signature and a name.

 

Tell them, that, as the Season of Goodwill approaches, you have offered them a further 7 days to at least have the courtesy to respond. And that the court will not look on their inaction favourably in 7 days time !!

Looks good to me, mate. In corre. with banks, I personally don't like to refer to my letters as LBA's or prelims - I always take that as a term of reference for our use here (and in court). That's my only suggestion, though - and nowt more than that !!

 

No, you better bike this one over to 'em, and tell the courier he doesn't get paid unless he brings you a time, a name & a sig. :grin:

Are you able to get anything useful tracking the original LBA online ? By that I mean, have you asked them what has happened to the letter? If it isn't signed for, then it should have been returned, I'm sure. If they've actually lost it, then they should tell you that, at least !!

Nah - been online 2 check again 2day but didn't get chance to phone 'em till 2night n just missed 'em as it closes at 7.30pm! Will deffo ring 2moro tho ... Life' a bit hectic 4 me on this week - I work shifts round my hubby's shifts - only 4hrs a day but this week I have to get LO up & give brekkie, play with toys & watch CBeebies, get her down for morning nap, ava shower dry my hair n get ready for work, get her up, dressed n ready for outta the house at 12 noon to take her to either my Sis or SIL for an hour b4 hubby picks her up on his way home from work!

 

Other shift is sooo much easier as I go to work n leave her in bed, hubby looks after her n I come home at 12.30 n take over - then I have all afternoon to do 'stuff'!

 

Phew - tired me out just typin that! :o

lol ... actually don't think I'll ever go back to 9-5 tbh .... luv workin part time ... just go ... do my bit n come home - leave all the responsibility to someone else now .... been there done that & most deffo have the t-shirt!

 

It's only every other week when LO goes to her Auntie's for an hour till Daddy picks her up so not too bad & at least she gets to see her cousins & Nanan etc on a regular basis ... she luvs it & is no bother - they all say how good she is & at least me n hubby know she's not going to strangers too ... wouldn't do it if she was ... the other bonus is it's free childcare!! Couldn't really afford it any other way!

I agree 100% - Nanna & Grandad might spoil 'em but that is who they should be with while you're not around. It's a pleasure both ways, innit ? Paid childminding just doesn't sit right with me, either - it doesn't quite add up one way or the other.

 

I chucked in 9-5 years back too. Made redundant & self-employed now. No big shakes - always skint (why I'm here !!) - but escaped nervous (& marital) breakdown. Working afties & evenings, so I kip as & when.

 

I would love to make money online like a lot of people do, now, but I think I'm the wrong generation. The new kids have got that well sewn up. I thought about helping non-PC-literate people claim charges for a %age, but it's frowned on and could be risky. Not thick-skinned enough to try it. Anyways, there are plenty of chancers already doin' it by now, I think !!

 

Nah - this'll do me. Still got wifey #1 (which ain't so easy these days), plus 2 great daughters, plus retained mental health (arguably !!)

 

When you see what rotten lives other people in this world lead - it ain't so bad here, is it ?

OK so I posted my 'Final notice before proceeding letter' giving another 7 days - recorded delivery today.

 

Spoke to Royal Mail & they have no further info about the whereabouts or if it'd been delivered etc so I have to leave till the 4th dec (Monday) before I can claim my money back! She did say they were behind at the moment being very busy but that it ought to have been delivered by now.

 

NOT good news for those of us with claims & deadlines at this time of year eh! :rolleyes:

Sorry to hijack your thread - but I'm about to issue Creation with a Prelim and I'm curious which department you sent it to and also how you figured out the compound interest rate. (I'm using the baby spreadsheet with 8% standard at the mo') My claim isn't very big so the compound would really help. Also - they claim not to have kept any of my statements from before November 2001 - is this legal? I thought they were meant to keep them for six years.

I used the throught claim compound contractual sheet from the Vampiress chambers in google for my claim. If you already have your statements to work from then don't worry about if they have them - they should still have records even if they can't acces the statements I would have thought.

That's ok! I really struggled with this too as they quote it differently on statements & couldn't find it published anywhere ... anyway managed to get help calculating it & worked with 29.84% annual rate compunded daily which should be as near as damn it. On my statements it states service charge of 2.2%

Quick one here for Cat: If it seems a possibility that they might come up with figures that differ from yours (eg if you have missing statements and are estimating), then it could be worth writing back to them to get them to confirm exactly which figures they do have, and in what form they are held. Also if any records are no longer held, get confirmation of their method and time of disposal/destruction. That way, it is difficult for them to surprise you with stuff later on.

Ok I'll calm down now n explain (bit excited there!:rolleyes: )

 

telephone call today from a LOVELY lady at creation apologising for the fact it seems my letter has been ignored ...really apologetic. She said they will be refunding ALL my charges & interest & this would be done 2moro! I explained I wanted a cheque but she said that as there was still a balance on the acc I technically haven't paid the charges yet so it had to be taken off my account but I could have a cheque for the interest. I started to argue (nicely) about this when I thought ... actually ... u know what .. i would prefer it to come off my balance anyway ... I don't actualy owe that much so it will just about half the balance anyway ... so I agreed to deduct the charges & the interest too.

 

I asked how much they were crediting & wrote it down & she gave her number if I needed to contact her again. I couldn't chek the amount whilst she was on the phone as 2 of my Sis's were here with the kiddies so it was a bit busy!

 

After they gone I checked & discovered the amount she gave was just the charges + Interest but not the contractual interest so I phoned her. She again was really lovelly & apologetic & said she was really sorry n just about to call me back as she'd only just seen the paragraph with the contractual interest claim details. She said she couldn't authorise payment of this herself but would e-mail her HQ straight away & ask them to authorise it. I asked if I could have that amount by cheque (not that it's a big amount but it will pay for some of my next round of court costs!) & she said she didn't see why not. She promised me a call to confirm 2moro!

 

Lotsa waffle there but basically it looks like this may be my first real total win!! *says she quietly*

 

I'm quite chuffed! This is only a small claim n it feels good so dunno how I'll feel when the 'biggies' come in! Can't wait ... also I will make my contribution to this site when I get summat juicy that's not just swallowed up in the next round of costs.

If they're finally being "nice" it means that their only chance of getting any reduction in what you're claiming is to make you feel sooooo guilty, because the nicey-nicey person you spoke too was so nice, you actually felt sorry for her. Brill.

 

OK., so be nice in return (magnanimity in victory !!) - but don't let them "forget" stuff. You might still have to "ever-so-nicely" keep reminding them.

 

Yeah - they've as good as caved in, so it's just a small matter of time, and perhaps a bit of nice persistence.

That is brilliant! Congratulations. Thanks so much for your advice, and you too Bill. I've already done a SAR and apart from gaps in early 2001 (which are outside the 6 year limit I suppose) after a chasing letter the information they sent me was complete. Fingers crossed I get a similar result.
