You usually get letter saying they are looking into it, last time I claimed they said it would take up to 4 weeks, not sure if this has changed due to amount of claims, you will then usually get an offer, which you accept as partial payment, see template in library. Halifax are generally much better to deal with than others Banks. As soon as your prelim expires send the LBA and yes keep to your timetable.

Hi Hardcore I am on roughly same timescale as you-also told my 'complaint letter' was received and response posted out yesterday,but not arrived yet. My LBA goes out 15th.

Prelim Sent -27/02/07....

Response Letter rec'd -13/03/07....

LBA Sent -15/03/07...

Court claim due-30/03/07

Offer received(10p/cent short)-declined for full amount-28/03/07

Success FULL 6yr amount offered-29/03/07:D

........not yet received because they want me to accept conditions!!:(

realy annoyed as my LBA was posted 1st class recorded on Tuesday 13th March and still not showing as delivered. :mad:

what date should i go from for the 14 day countdown to starting MCOL?:confused:

This has happened to me a couple of times with my daughters hsbc claim, but it does eventually update and they have usually received it the next day. Just to be safe perhaps add 2 days onto your 14 days to have given them time to receive it, I usually count the 14 days from date of receipt anyway, but proceed as planned you have proof of posting.

My recorded didn't show as delivered either but I phoned Halifax and they HAD received it.Think there are so many recorded delivery letters maybe they are being signed for in bulk (or not at all).Anyway just keep to the timescales-have you got that interest totted up yet?!

ok, having a little dilema in my mind.

will be filing MCOL on Wednesday 28th March as per my timescle.

Does anyone think its worth ringing Halifax on Monday 26th and saying "look, im about to take u to court, pay up before Wednesday or incur court costs and interest"

Seems that claims are taking longer and longer to deal with. guess im just impatient.

Also once i file MCOL, how long does that give them?

It cant hurt to phone, and at the moment they are settling a load of claims this way.

 

Once you file, they have 28 days from when it is deemed served. (which normally takes around 5 days)

well i just got off the phone from Wendy in Customer Relations Dept.

I said that i had submitted a claim for my bank charges 4 weeks ago, and that this wednesday will be the day i submit my claim to court. i asked if Halifax would like to settle the claim before wednesday and therefore not have to pay court costs and interest.

She replied that they have 8 weeks to respond to my claim and that is what they are sticking to.

I think it seems to be if you are lucky and manage to speak to someone with authority.

 

Strange them rattling on about 8 weeks as in my letter they said they have 8 weeks to repsond ....but would like to resolve it in 4 weeks if possible..:rolleyes:

 

Oh well...time to start adding on the extra interest!!
