Hi all,

 

I'm writing on behalf of my mother about PPI in relation to her mortgage.

 

She paid PPI for years unknowingly and contacted her bank about it a while ago.

 

They said that they were not going to uphold her claim as they felt she wasn't mis-sold PPI.

 

Shortly after she contacted a company who deals with PPI claims (unsure which one) and they took on her claim.

A few weeks after they got back to her and stated that because she had contacted the bank herself about PPI, they were going to drop the case.

 

Is there anything else she can try, or any info on where she might stand with this?

What reasons did she give for the mis-sale?

 

Who is the lender?

 

How did she complain, i.e. on th phone or in writing with the relevant completed questionnaire?

 

What reasons did they give for not upholding the complaint?

 

When was the loan taken out?

Just phoned her and she said that they didn't tell her that if she got into trouble paying her mortgage the PPI insurance would only payout for 12 months.

 

She complained to Nationwide by letter. Nationwide didn't uphold her claim because they said they gave her a leaflet which detailed that information and she didn't opt out.

 

Loan was taken out in 2000.

 

Key Financial who dealt with her PPI claim after advised her that she had a case and then backtracked about a month later saying that she no longer had a case because she contacted the bank herself previously.

The refusal letter if I remember rightly was maybe no longer than a month ago.

 

I believe I have heard my dad advise her to take it to fos but she is losing motivation. I'm trying to persuade her to give it a go.

She has six months from the date of that letter to refer it to fos.

 

She has nothing to lose by doing so and it won't cost anything either.

 

Alternatively she can challenge Nationwide herself although if she is losing motivation that may not be something she wants to do. In that case I would pass the whole thing to fos to investigate.

There may be some additional mis-selling reasons that can be put to fos as well.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
