    • wont go near it with a barge pole as its ex gov't debt.
    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.
    • was at the time you ticked it  but now they've still not complied . if you read up, here , you'll see thats what everyone does,

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Looking for some help.

I am 31 years old, have 2 children - 7 and 8 - one i get DLA for middle rate care. I am 25 weeks pregnant, self employed earning £120 PW 20 hrs per week - currently living with partner and we get child tax credits and working tax credits. I will be eligible for maternity allowance at 29 weeks time.

Partner and i are splitting up - i am moving to a different area to be closer to my family for additional support etc.i can take my line of work with me. Ihave found a house i would like to pursue with in an area which has a good school for the children - the rental is £675 PM - estate agent wants £110 reference fee, £40 contract guarantee fee (?) and then the £675 deposit and 1 months rent upfront £675 - all in all around £1500.

Here is the problem - I have a rubbish credit history due to money problems so i doubt i would pass the credit check - also the estate agents say they would want to check i am working full time and i can afford the payments - they don't except DSS!! i maybe able to get the deposit together and know i would receive help with rent and have enough to live on etc its just the credit checks that are getting me down! Ideally i want to be moved by the end of October - the baby is due xmas time so want to be settled by then.

Will they refuse me the propertys i am looking at if i have a poor credit history? also how do you get around the NO DSS policy?

Council houses are a no go - all in bad areas up there,

Also how much of my rent can i expect to get help with? between £550 - £700 is the average rental in the area.

Any suggestions please?

Thanks

Its a difficult situation - private renting with bad credit history, and something really needs to be done about the credit checking policy. We faced a similar issue renting, and ended up not going through an agent, but going through the private 'property to rent' adds in the paper. Some will still want to credit check, we found one who didn't - but they still wanted evidence we could pay the rent, luckily we were both working. With an agent your options are to pay an additional amount upfront (this is at the discretion of the landlord to accept the arrangement) - sometimes up to 6 month's rent, or you could find someone who is working, with a good credit history, to be a guarantor - you would have to pay extra admin fees to have them checked out.

Regarding how much rent you'd get help with, this depends on other things too - for instance how many bedrooms the house has and what the local housing allowance is for your area, and also exactly what your income is.

As a private tenant, the maximum Housing Benefit for a single parent with 2 young children would normally be determined based upon the Local Housing Allowance for a 2 bedroom property in the area you are moving to

You can check the LHA rates for the area by looking on the Local Authority's website.

The LHA rate will be the maximum level, however it may be reduced if your income is higher than the amount the government says you need to live on.
