      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello :)

I had a log book loan with CarCashPoint, I have fallen behind with my payments due to illness, I've bipolar disorder. I have been totally upfront with CarCashPoint and said I can't afford the monthly repayments and could I reduce them until I get back on my feet. I was told NO. I'm in arrears of £530 and I'm now told I have til Friday the 7th to pay or they will be calling the bailiffs. I've pleaded with them but they are being so unhelpful I just want to cry. I called National Debt Line on Friday and they were fab. So helpful. I was told to ask CarCashPoint if they had the bill of sale and if it was stamped by the court. They have. I asked again if they could help me to be told NO again. NDL said to apply for a time order but I'm not sure what to do and I'm now in a panic. Any advise would be grateful right now. I can't get in touch with NDL sadly

I had a similar problem with Mobile Money recently. All they suggested was to refinance the loan over a longer period of time, which would reduce the payments. Of course, this only increases the total interest payable. These guys are just crooks. Have a look at my posts and you'll see the problems I have been having.

Luckily, I have been able to raise some cash and they have agreed (begrudgingly) to reduce the settlement figure. Okay, not by much, but persistent with these people does hellp. I'm not saying that I can guarantee they will help you, but anything you can offer to them will help your cause. Best of luck and let me know how you get on.

Thanks for coming to my aid davystsea :) I'm now trying to raise the arrears as I've now been told I can't do a time order for one of these as it's not regulated by the credit consumer act! Not sure if that's right or not but really feel like I've been hung out to dry. Car cashpoint are now ignoring me so I know I'll wake up one morning to find my car no longer on my drive :(

Cant call bailiffs without a court order. And they wont get one if you can prove that you legitmatley want to repay, you just need more time.

 

The only thing they can do is ask for you to voluntary surrender the car. Especially if you have paid more than 1/3 or half the amount of the finance already. If you have paid that, then their only option really is to try and take it to court.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

All due respect, but the above well intentioned advice is absolute nonsense.

 

Get some free but qualified advice,CAB, see if this Car Crashpoint business is part of a trade association - if it is then the association will usually have a dispute or complaints procedure which will be close to being independent.

Well the car got Repossessed and they wanted me to pay the whole debt off to get the car back which was £3500. We couldn't afford :(

We've complained to their trade association and that's all we could do. Car went to auction on Friday.

We brought a £1000 car and the moral of this story don't take out car loans and log book loans as if you fall in the s**t your screwed!
