    • If you look at some of the other debt related threads will see that one of the first things which will be asked will be for you to list out your debts in a brief chronological order, including date of debt, amount, creditor, amount outstanding, defaulted – yes/no – date of default, date of last payment made, have you acknowledged the debt at all to the creditors. That lot at least. I expect that my colleague @dx100uk will be along but will meet to know at least that information
    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone,

 

Friend has been issued Claim from solicitors via MCOL for an accident he caused (shunt from rear). Fully comp.

 

Issue date 13/6/12. AOS ???

 

Was being dealt with via insurance.

 

I will see POC in the AM. No reference to preaction protocol mentioned. Was read out - claim is less than 1k - damage only not PI claim.

 

Will send all docs to his insurance company BUT in the meantime holding defense should the insurance take too long ?? Does not want CCJ by default as will affect life.

 

Any nicely worded doc to send to claimant ? Failure to comply with PAP ? Possibility of application for strike out ?

 

Any help please (would like to put to bed tommorrow !)

Needs to be passed onto their Insurers. Suggest that he phones them tomorrow and gets a name of someone he can post it to, who will make sure it is dealt with.

 

Because a policyholder delegates liability issues to their Insurers, I don't think they will like him acknowledging the claim or doing anything with it, unless they tell him what to do.

We could do with some help from you.

Thanks UB, thats the plan, but I hate chancer Solicitors - friend is more than capable of settling tommorrow and would have but phoned me instead!

 

My fear is once paid, admittance of guilt and a further claim for PI in the 1000's....

Pass the Claim Form to his insurers urgently and make sure they deal. It is the insurers fault he is in this situation as they have obviously been slow to deal with the Claimant's claim.

 

I agree with UB, he should not submit a Defence. The accident was his fault and so his insurer will admit liability soon enough.

 

Nothing he can do if the Claimant is going to make a personal injury claim I'm afraid. Just make sure his insurers are quicker to deal with it this time.

Update -

 

Insurance company were U/S. The sent one letter to claimant, missed the AOS date......luckly WE got in on final day....

 

Sent a strong letter to the claimant, primary part of claim had been settled but defendants Insurance sent chq to driver not the lease company, and the driver cashed it!!! Lease company was claiming...

 

Gave notice that we would file a fully pleaded defense on 5th July - after which if they continued we would be seeking wasted costs.

 

Phone call at 4.50 on 5th saying they had discon'd. Confirmed with bulk centre that was the case the following day...

 

So frankly the insurance company 1st something were pants, numbers and defendant were ace....

 

The sols are well know in the yorkshire area for bulk issuing......

 

Oh, I got two bottles of wine and a scratch card and won £50!!!! as payment....
