      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I was late paying Mobilequid this month and as a result ended up owing them £300. I payed the outstanding amount on payday (1 June) and was happy to have that be the end of that disaster!

 

On the 8th June I noticed a further transaction from them for £250 which shouldn't have been there. I was aware I owed 300 and that was paid. I have tried emailing them with no response and a number for them provided by the bank is unreachable. I have spoken to Visa disputes who states they cannot help until Mobilequid confirm the money taken in error and I have had a loan with them and this money may have been part payment. The 250 is shown as being taken on the 31may but didn't get authorised at the time due to lack of funds, it appears it has now gone through. I have emailed Mobilequid again and still nothing.

 

£250 is a lot of money and I'm completely stumped as to what I should do now, can anyone help or advise me

Could our old estonian friend have made yet another PDL? This PDL is based in Estonia, and has the same hallmarks as the other one.

 

One thing is for sure. You MUST get a full complaint in with the PDL, your bank, OFT and trading standards.

Sorry I'm a bit confused by the Estonian comment. Do I have to wait a period of time before complaining or should I just go in now guns blazing. Visa disputes recommended speaking with trading standard but I'm a little bit clueless tbh!

Nope. They have stolen from you as well as broke OFT guidelines. You MUST report them to the OFT, trading standards and file a formal complaint with the PDL. You must also inform the bank to do a chargeback ( if it hasnt been a substantial amount of time since the transaction happened).

 

As for the estonian comment, there was a PDL owned by an estonian guy and was registered in estonia. Lets just say they had little respect for law and regulation in the UK.

Gotcha thanks for your replies and help so far. Visa disputes for chargeback said that they couldn't dispute it without proof that it wasn't part of a loan payment, I explained that I had an email confirming the loan total of 300 had been repaid but they said as it is a loan company I would need a break down of costs from them proving there wasn't anything further to pay and until Mobilequid respond to my messages I can't prove that.

 

I telephoned citizens advice consumer advice line from the oft website and they will be passing my complaint on to oft but have advised me to send a recorded letter to mobile quid dispute the extra charge and giving them one week to explain or refund the amount, if I get no response within the alloyed time I should then call the FOS.

 

Does this all sound correct? Is there anything more I can do? Sounds as if it'll be weeks if not months before I see MY money :(

You need to follow the law in cases like this. It's never fast or easy, because if it was, everyone would be trying to say payments made were fraudulant or stolen. Thats why there is a system that investigates it.

 

Do what the CAB said. Send the PDL a formal complaint by recorded delivery, and demand that they give you a final response. If you get a final response, or 8 weeks elapse (whichever comes first), then you can contact the FOS who will do their own investigation.

Morning to everyone!

Just had to update on this. I was extremely shocked and almost fell out of my bed this morning when not only did I wake to an email from mobile quid, but this email admitted fault and states they have refunded my money :O

Of course it's not there yet but I'll be check to see if it reappears! Totally unexpected!!

I hope they are paying you interest at their rate until the time you receive the money - I would also be charging them their standard missed payment fee as compensation and any other costs you have as a consequence of them raiding your account.
