    • Dear all, some information/advice required please.   I recently received a Further Steps Notice about a fine from 19/03/2018 which I knew nothing about. It was regarding a vehicle parked on the street without tax ( It was covered up and there because the only key to it had been stolen, I had been away from home  and I was having trouble getting a new key cut and coded to the vehicle )  I had not made a change of address to DVLA which would be why I knew nothing about the fine until receiving the final steps notice dated 29th April 2024 and giving me 10 working days to pay, although the notice did not arrive till May 9th 2024. I emailed the London Collection and Compliance Centre on May 13th 2024 asking for any information and they sent me a copy of the original fine. It is for  £390 back vehicle tax, £85 cost and £600 fine.  I now have received a Notice of Enforcement dated 7th June 2024 demanding payment ( total £1036)  or an arrangement by 6am 15th June ( tomorrow )  My question is is it tool late now to question the £600 fine part of the total amount to be paid ? That amount seems punitive.  Would making a statuary declaration regarding having no knowledge of the original court date apply ? And any other advice gratefully received. I am on Universal Credit and apparently they have already taken £177 via benefit reductions which I wasn’t aware of, but does make it seem strange that they were also unable to contact me.    Many thanks for any assistance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was put in WRAG a few months ago and had my initial interview at the Job Centre so I would say within 1-2 months. It seemed to be a correct your info and telling me what they offer. Plus having to attend some stupid Information session.

Work for my local CAB but my views and advice are my own. Try AdviceGuide or Adviceline (08444 111 444) for CAB help ;)

there you go. Transport is up to you, bus or taxi but contact them beforehand (according to my letter), so you can get your money back ;)

Well didn't have to wait long, appointment letter arrived today, got one in mid May.

 

Now the problem is how I get there, will have to contract them so they can arrange transport for me.

 

Life-Goes-On when did you pass your esa. im in that wrag group i passed my esa mid march...

Had "Medical" 23rd Feb, found out I was in WRAG about a week later

DWP will not be able to arrange transport for you.

If you have a medical condition/disability that means that you are unable to use public transport or do not have access to your own transport then you will need to contact your JCP beforehand for a taxi fare to be agreed beforehand. In some circumsyances the interview can be conducted either by a home visit or by telephone but this will not be the normal method of appointment. If you are placed in the WRAG then you will be expected to be able to travel to the office for the interview.

As it happens I should be ok getting to the interview.

I live out in the sticks, but have a local bus twice a week that will collected me from my door and drop off mostly where I need to go.

This only runs Tues & Fri, and date is a Tuesday.

 

Will have to make sure interviews are only Tues & Fri.

That would not be a problem in the office where I work, if transport is only available on certain days or times then appointments will only be booked where it is reasonable for both the customer and that also fit in wit the advisor diary.

When you attend the appointment make sure you keep your bus ticket to receive your expenses back and just ask them to note your records that limited transport only running on the days and times will restrict you in the future if required to attend.

I cannot guarantee however that the people who book the next lot of appointments will actually read the notes back in full however so you may have to call to rearrange in the future but can always state that your records are noted to show thios from your previous appointments.

I had my WRAG meeting on Thursday and have to attend an information session with the Work Program. Think you will have to attend that first and if you stick with Job Centre, I would think every 3 months maybe?!

Work for my local CAB but my views and advice are my own. Try AdviceGuide or Adviceline (08444 111 444) for CAB help ;)

I have also recently been put forward for this wrag program.

 

I asked some advice about it on here as I now have MS as well as my mental health condition (anxiety/panic disorder).

 

I was told on here that there is an appeal form you can submit called the 'support group' for ESA people. This as far as I am aware is for people who are mentally or physically (or both) unable to attend wrag. I've not got the form yet but they are posting it out to me.

 

Worth looking into in your case i think.
