Hello,

 

We ordered a printer from Arogs to be delivered on Wednesday I waited in all day on and it was not delivered. I sent them an email complaining that the item had not been delivered. The next day the Item was delivered and our neigbour took the item in. Then the next day another printer was delivered for us again. We now have 2 of the item that we bought. Where do we stand should we be sending the item back. Is it classed as theft if we keep the item. Should we wait until we are conected by argos.

You could wait until they contact you, and hope they never realise their mistake (not an impossible scenario with Argos :rolleyes:), the problem is that in 6 months time, they could demand payment... And you can hardly claim you didn't know anything about it, which would leave you in a precarious position.

 

Or you can write to them, stating that it is an unwanted item, and that they have 7 working days to collect it, or it will get disposed of, as you have neither requested nor need a second printer, which is totally within your rights.

 

Unsolicited goods are those which have been sent to you 'out of the blue' and which you have not ordered. The Distance Selling Regulations state that you can treat these goods as an 'unconditional gift'; in other words, you can keep them or give them away, sell them, use them or destroy them, and the trader cannot expect you to have to pay for them.

The Regulations make it a criminal offence to demand payment or threaten legal action to obtain payment for unsolicited goods or services.
