    • its SJPN you simply fill the form in pleading not guilty. you will then be sent a latter court date by letter to appear at your local magistrates court or the DVLA will might even drop the whole case. if you want ,fill in the small section of the form too, simply stating that payment for said road tax was cancelled and latterly reclaimed as a new DD was already in place. hence i double paid for said disputed period of the claim. just to be 1000% sure. please scan to PDF the page that states what you have been summoned for.  read upload carefully
    • HI DX Yes check it every month , after I reinstated the second DD I was checking every week. Also checked my bank statements and each payment has cleared. When responding to the court claim does it need to be in specific terms ? Or laid out in a certain format? Or is it just a case of putting down in writing how I have explained it on CAG?

    • You have of course checked the car is now taxed and the £68 is stated against  the same reg?  If the tax for the same car did over lap, then I can't see you having an issue pleading not guilty Dx

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi -

Certain words and phrases on this board are linked to pop-up information. I would like to de-activate that function, it stalls my browser (Firefox on W7) and interrupts my viewing when I accidentally pass over a live tag.

Does anyone know how to achieve this please?

Thanks

Thanks seanamarts - it's already active, but it doesn't have any effect on the CAG mouseovers - they appear as semi-transparent overlays, obscuring the text I'm trying to read. the effect - see below - occurs whenever my cursor/pointer passes over an underlined text like "a new thread".

You are talking about our autolinks.

I'm sorry but you can't disable them. They are normally very informative and are useful to a huge number of people who come to the site. They also save the site team having to repeat the answers to many common questions.

Because of this we pefer to have them installed.

On has to get used to not waving one's mouse around when reading through threads.

Mind you, I don'tknow why you get them displayed as per your ff jpg.

The display that you get in chrome is correct and it should be like that in all browsers.

You can disable these popups by using a firefox addon called NoScript.

The addon will put a small box in your menu bar and you can add consumeractiongroup.co.uk to the untrusted group (We all know it is trusted but in this instance we use untrusted to disable these auto links).

This will stop all scripts from working so you may need to switch to trusted for certain options to work on the site.

With the site 'untrusted' the autolinks will no longer bother you.

Thanks, ashmk - that did the trick. Ironic that I have to treat CAG as untrusted, but forced, intrusive pop-ups are not a good thing.

Which version of Firefox where you using, out of curiosity?

11.0 on Win 7 32 bit, with an aggressive Adblock Plus plugin (which was successfully stopping all the pop-up formatting, but couldn't catch the text). NoScript has nailed it - I just need to set CAB as an untrusted site, so kudos to ashmk.
