HiyaVery new to the site and the internet so please be nice.... Was parked in Dereham in a carpark Ive used for years and got delayed at the bank. Consequently I was over "time" in this carpark. Unfortunately I was driving the other halfs car. Big oooops as the Parking Contravention Enforcement Notice went to him. Today is the final day for paying at the smaller charge(£45) and although Ive read lot on this site, Im very wary on what to do. The notice has a clear photo of (my booootiful parking lol) of the car but they have the color wrong on the details bit. Ive got a cheque written out ready to send.....BUT I dont want to part with it! Please can you help? The other half does work away so can provide proof that he wasnt driving the car at the time.

Take that cheque and shred it. Do not pay them a penny. If you do you will have fallen for their little [edit].

They will send you a chain of letters with increasingly more red ink but they're all absolutely meaningless.

They can take as many photos of your car as they like but it's a waste of their time as it does not identify whoever the driver was.

Just let them send their silly letters, carefully file them in the bin. Any questions, just ask.

Hi Cardiff DevilThank you for your reply. I will iggy them and file their letters. Yes the photo doesnt show me at all (thank goodness). Do you know how long they will keep hounding the other half? Must say he doesnt really care but I really dont want to end up in a court and facing a big bill.Cheers

The typical PPC process goes on over a few months, but it varies between companies. Realistically you can expect two or three letters from the parking company, then a couple from a debt recovery outfit then usually one or two from a "solicitor". After that the letters will cease.

 

If you go onto MoneySavingExpert, find the parking forum and have a look at the thread called "what to expect", you'll see copies of the letters that other people have scanned in. To a person who's never encountered this [edit] before, it can be quite intimidating, especially with some of the threatening language and terminology they use but you have to remember that the whole point is to scare people into paying up. The amount of money being demanded will keep going up as the letters continue but again, don't let it faze you, this is all another part of the [[problem]]. The letters on MSE have been received by hundreds of people, who have succesfully ignored them with no repercussions at all.

 

They absolutely, 100% will NOT take you to court, no matter how much they may threaten it. The fact is that they know they would lose in court so it's not worth their while to try. If they rocked up to a county courthouse and said "this person parked in our free car park for 10 minutes longer than they should have, we want £250 from them", the judge would take one look, laugh out loud and send them packing.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As you were driving the other half's car, then their little scheme falls at the first hurdle. They will get the RK details from the DVLA, which will be hubby. They will writer to him which he can merrily ignore. If they were ever daft enough to take him to court, then he simply states he was not driving. He doesn't have to prove he wasn't driving, they have to prove he was. The fact that he can prove it is a further ace up his sleeve. :)
