      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i had a loan for £200 from toothfairy nearly 12 months ago,

i missed the pay date due to my wages been cocked up,

so they added some charges ,

 

i called and said it would be there the following friday,

 

but they tried to take it out on the tuesday, wednesday and thursday, ,

the funds weer'nt there so i was charged 3 times by them that week and also by my bank,

 

to cut a long story short, the payment was so big that i couldnt pay it all in one go ,

we arranged a payment plan of £40 pw till i had paid off the nearly £500 .

 

everything was going fine until my wages went in a day late due to a bank holiday,

i called ndr and told them what had happened and that there would be £120 in my bank foir them in 3 days,

this would be the week i missed, the current week and the next week,

but asked them not to take anything out of my bank for the next 2 weeks

as i would be up to date and it would give me time to get straigh.

 

they took the £120 on the tuesday and then £40 on the thursday that left me short to pay other bills,

ive spoke to toothfaiyr, ndr a cpl of times to try and sort something out but i end up hanging up on them and will not talk to them on the phone,

i find them very rude and intimidating,

 

my loan now is £1,560, ive paid £200 off the original loan that should of been £275 in total but theres over £1,300 in charges,

 

ive just had an email and letter saying they are going to pass my file onto the anti fraud police as they are sure i gave wrong details,

they have my address, email, and mobile number,

 

id dint give them any false information,

 

ive asked for a new payment plan but they refuse,

they want the whole £1,560 in a one off payment,

god knows what im going to do,

 

are the charges legal and any bit of advice will be helpful,

ive been to the cab but they arnt much help ,

 

im not botherd about the baliffs as i live with family and dont have anything they could take,

and im not really worried about the police as ive nothing to hide,

im just worried about the size of my debt

This seems particularly odd. Why would they assume the details you have provided are false?

 

Can I ask you to clarify the full name of the company? I've had a look on companys house and found this:

tell them you card security has been compromised

and that toothfairy have been taking money out when not autorised to do it.

i'd not pay anything more to them

 

they'll never go near a court and have been warned about this behaviour by the authorities before .

 

as for phonecall STOP TALKING TO THEM ON THE PHONE

 

you have NO LEGAL OBLIGATION to speak to them AT ALL.

 

everything in writing.

 

start to get a papertrail on them

 

then you'll be able to hit them in court.

its becuse i wont answer my phone to them and ive already told my bank not to pay them, as they are taking money out, or trying to 2 or 3 days before its due date, i will not speak to them, i feel like dragging them through the phone, they are getting an agency to check that the IP address i made the application from matches the address i gave them, it all sounds a bit much to me but thats what the letter says

Well for all they know you could have made the application from someone else's computer, a public library, or any multitude of locations.

 

Is this a professional set-up, or some sort of Mickey Mouse company with a 'Phil Mitchell' character at its helm?

 

I would disect your agreement with them. Challenge - in writing - each and every additional charge. Their conduct. Their professionalism - or lack thereof - and commence a formal complaint. Firstly, within the company (although I doubt you'll gain much, if any, ground with that) and then perhaps escalated to a governing body?

the letter threatening the police was from NDR they have given me 3 days to contact them, i just want rid of them but i am not going to pay nearly £1600 in charges and interest

 

sorry you have a letter accusing you of fraud and they are going to send the police around

 

what because you wont pay their unlawful penalty charges

 

really

bet the OFT would like to see that.

 

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

thanks i will do if i can get my head around all that, im just reading the letter again , NDR say we have been passed your file by our client toothfairy , this has been fsat tracked to us as we have reason to believe you have supplied our client potentionally FRAUDULENT information in order to obtain credit , this is a SERIOUS matter that must be dealt with IMMEDIATELY,, FAILIURE TO DO SO MAY lead to this matter been passed to the police fraud squad
