Now debt free myself, i am trying to help a friend out who is in debt. He has many debts so i said i'll try and tackle them one at a time.

 

Below is the reply to a CCA request from Santander for the first. Any views on if it is enforceable would be kindly appreciated. I maybe wrong but i cannot see a 'right to cancel box' and it was signed at home.

There is then about 8 pages of terms and conditions which i can upload if needed.

to be honest

the days of using a 'paperwork error'

to wriggle out of debts are long gone.

 

your best bet might be to first check his cra file

 

then deal with what shows

 

reclaiming might well be worth while too

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

i'll have a look at it over the weekend. By saying paper work errors are long gone, do you mean in terms of the courts can and most probably will enforce it if errors have occured?

 

I did ask them for a statement of account (breakdown) but they didnt send this. He says there are a lot of charges on there for missing payments etc. Can these still be claimed for?

typically we now see that with a clear financial link and statements

judges are no longer being hoodwinked.

 

if its not his debt then fair comment and use it

but if it is

i'd be very reluctant to recommend my mate to go to court and say its un-en

Emmm, seen lots of those all enforceable, but as DX

has said paperwork errors are now very unlikely be

a stumbling block on enforcement
