    • OK but it's always best to scan up these letters you mention so We can decide proper actions/responce/use please scan them all to one mass pdf in date order.  Read upload use the online sites listed Dx
    • Instead of ridiculing them you could point out the embarrassment they will have in the papers if they persist in being in Court with a little old lady. it also won't look good for their landowners since negative comments afffect them too.
    • I'm going to say they haven't complied with the PAP although they did write saying they would be issuing a court claim in their letter they also state I had an agreement with OVO which they have a copy of the agreement and its terms and condition which I have definitely not seen. Also I've technically never had an agreement with OVO but with SSE I didn't even realise they had sold to them until this letter!
    • I have had a pre "warning" from TM Legal regarding 2 old debts stating they are going to send a claim form in email. I was sent a PAP form which i responded to on both but like a melt i sent their PAP pack back to them in my request for CCA etc using the CAG response form. I have not to my knowledge received a response for either. my question is, will sending their pack back cause me issues in the future? can I request they send this back to me?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, reading what you have said about this company it's almost like I wrote this myself.

 

I have been batteling with them since December and don't seem to be getting very far.

Like you my bank have flat out refused to help with this situation which I find absolutely unbelievable.

 

I was shopping round the internet looking for a short term loan just before christmas and went on to quite a few sites but couldn't find anything that suited my needs.

On 22nd December I was off out to go christmas shopping and discovered when I went to the cash machine that money was missing from account.

there was no record on my statement as to where this money had gone and so I contact my bank to find out what had happened.

 

I was informed by them that a compay called Enhance Finance had taken the sum of £69.99 from my account.

Like you I had never heard of them and challenged this with the bank and asked them to recall the payment.

I was told that

1. The payment could not be recalled because it was a card transfer and

2. they don't get involved with loan companies.

 

I was gob smacked to say the least,

I have never taken out any payday loans of any sort and certainly would not agree to pay someone seventy pounds to find me a loan, mainly because of the financial situation I am in.

 

The bank gave me their number and told me to phone them along with the transaction number which they gave me.

When I finally got through to the comapny they told me it had nothing to do with them because they don't take the payments

and to phone a different number which they so very kindly supplied me with before slamming the phone down.

 

I rang this number and got through to a company that wouldn't even give me their name.

I spoke to someone called Emily Worthington who told me she'd send out some cancellation forms and to return them for a refund but that it would take 30 days for me to receive it.

 

I received the forms that day which I filled out and returned to her straight away.

I also cancelled my visa card as I was worried that they would try and take more payments.

I heard nothing and have not received any refund, but it doesn't end there.

 

I got up yesterday and checked my bank as I had just been paid, only to find that Myloan had taken £69.99 from account.

Again I had no idea who this company was or that they are associated with Enhance finance.

 

Once again I phoned my bank and asked them how this company was able to take money from account when I had no idea who they are AND that I had a new visa card.

Like you I was told that I MUST have made an agreement with them.

 

Once again I explained the situation and once again was fobbed off.

I got in touch with Myloan using the same number I had used back in December (all these companies are under the same address and number)

and asked why more money had been taken from my account when I hadn't even received the first refund.

 

I was told to resend the cancellation forms and send them a copy of my bank statement to prove that money was taken yesterday as they had no record of it.

 

I resent the forms while the girl was still on the phone and asked for an email to acknowledge that she had received the forms.

i then sent a censored copy of my bank statement showing the charge from yesterday. I was astonished at the reply I received from the same girl

... "That's not us, there's another company with a similar name and we didn't take that payment".

I beg to differ because the bank traced it back to them.

I don't know what to do about this second transaction as the bank are refusing to do anything and the comany are denying that they took the money.

 

I went online yesterday and found a site called canyoutrustthem.com and there are hundreds of people who have had exactly the same experience with this comany and it's sister companies. Unfortunately I don't hold out much hope of getting my money back after reading some of the posts.

There isn't one example of anyone receiving a refund.

there must be something that can be done to secure the return of our money from these people.

My bank has just refunded me a similar payment through chargeback.

 

Insist they do a chargeback and quote them the Visa Debit chargeback guarantee:

There is other links which i've got though i'm sure someone else could help with those.

 

Another thing is that you only have 120 days from the date of the transaction so if you say it was december you might want to be quick. (maybe your bank is just stalling you?)

 

I would keep pushing it, ask for a supervisor etc....
