      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Today I rang them when a debit appeared from Payday Express on an account which was empty and had no overdraft! They immediately said that all future transactions from that company would be reversed.

 

I trust that includes the debit that you mention here that has taken you into unauthorised overdraft and that there will be no charges ??

Tell your bank that vthe whole account is compromised and you want a new account with a new card and account number.

Actually Brigadier I think that will resolve itself since that is supposed to be a savings account and they don't like people using them as a current account. They have written and said the card will no longer be a debit card but just a cash card. I presume therefore they will refuse all payment on it after that.

 

I think I will just close it and open a simple savings account with another bank.

Yes I've had the same notification about a savings account, but I'm not sure yet what impact this will have on CPAs set up on such accounts I have made an enquiry to my bank, but have not had any reply as yet.

I tell you one thing I don't understand Brigadier. How can a CPA take money out of an account when there is none in it, whereas if I took the same card to a retailer and tried to pay for goods, it would be refused.

 

I have a £25 debit on that account which does not have an overdraft facility!

 

Do CPAs mean that you could take £1,000 out of an account with nothing in it? If so, what is stopping them emptying every bank account in the country, and then just keep going £1,000s into overdraft?????

That is a question for your bank to answer, if the account is empty or overdraw imo the payment should be declined.

A CPA I believe is being abused if any more than the ''due'' amount is taken or funds are taken more often than authorised,

this is I think down to badly trained and ill informed bank staff, my personal view is to bombard the banks ''retail banking director''

with Formal Complaints about this conduct.

If the bank bounces a payment, they make money. With a CPA they dont. So they let it go through, then try and change the account holder. They know its wrong, they know the law. But these are the banks who think the law doesnt apply to them. THey brough tthe world to a recession, there is mass corruption in the banks, the Libor scandal....

 

It wont change anytime soon.

HiyaIm sorry to jump on this thread but am unsure how to start a new one. I am in the process of srtting up a DMP but am having a few problems with payday lender MiniCredit!!I have requested no less than 6 times to cancel the Continuous Payment Authority via email and a letter sent recorded delivery however they are refusing to acknowledge the request without a signiture and alternative card details.I am aware that I am not obliged to give them alt card details and as they didnt require my signiture for the loan in the first place (therefore they have never seen it) I am dubious about giving it to them nowAny suggestions? Please help :-)

You cancel it with your bank, not with the creditor.

you do request demand insist insruct for bank vebally and in writting that payments

must cease!!

Agreed seq. Unfortunately pdls usually say no. But as you say, its best to cover all bases.

Follow the advice in the thread. If Nationwide fail to adhere to them, you need to issue full complaints with the bank and regulators, then if they still dont refund the money or they keep allowing more money out, you'd need to issue a lba then court action against them.

Unfortunately if the card is linked to the same account number often payments can still be taken, best to keep a close eye on the account.

Hi jus been reading through these posts and iv got a bit of a predicament.basicaly I followed the advice on the forums,I printed off a letter to hand to my bank(Santander) requesting i cancel any cpas on my accounts.the guy had a look at my account and basicaly told me he can't cancel nothing as there's nothing on my account showing yet as the pdl hasn't yet tried to take any money!he advised the only way to stop them taking money is to cancel all my cards?is this true?my loans are with quickquid and wonga,and I haven't yet had any payments come out yet.i also found it strange that the guy not once asked who the cpas are set up with??any help will be greatly appreciated
