    • Hey 👋  thank you so so much for taking the time to give this advice. As soon as we hear back from them I will share it with you. 
    • Hopefully by mid July my credit file should be cleansed. They have said it takes 56 days or they have 56 days. That should be the end of it. I asked if I could have an apology and be compensated. I got a 'we are sorry for the inconvenience' and all we can offer is a £20 voucher to use on studio. I said thanks but I'd rather boil my eyes in acid than shop with you. I wasn't expecting them to compensate anyway, I just thought I'd ask. I just want my credit file sorted, my account closed so I can put this mess to bed. Thanks for the help, hand hold and encouragement, it has been very much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi to one and all .

 

Just got hold of my credit file online ,

 

I believe there is an incorrect entry on it , which will fall off in 3 months anyway.

 

The entry relates to lyods tsb credit / store card .

 

I never had any dealings with lyods and have never held a store card.

 

Im a tad confused though with some of the information .

 

It states the credit limit history £4,000 (04/06) £3000 (10/04) £2000 (04/04) now im assuming that the numbers inside the brackets are dates?

04/06 relating to April 06? Is this a correct assumption?

 

If so the account defaulted 13/3/06 two or 3 weeks before the limit was raised.from 3 to 4 k .

My financial troubles started in 04 so there is no way i was still paying anyone in 2006.

 

Also anyone explain what the question marks are for on the status which reads 8 8 in red followed by 9 green question marks.

 

Does one of these marks cover Jan to November of this year?

Like i say I dont believe the debt is mine due to defaulting in 06

and it will fall off 13/3/12

just wondering if my details have been used.

 

the balance sits at £4,410 DCAs ever mentioning that amount. Another thing I have just noticed is the default balance is as I stated 4,410 but in the balance it reads under the red 8s 4,411 twice then £0 under the question marks , someone has paid a quid somewhere and it def wasnt me

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I have never had a flat mate , just me and the Mrs . I just wonder was it a credit card backed by lloyds just under a different name ie aquacard or something . It still should of been off the radar anyway due to financial troubles from 04 . Im thinking maybe a nice DCA has paid a pound of the balance in order to keep the file open . Its not an unknown tactic I believe.

Many companies will default after 1 missed paymentin particular

''loans'' taken when paying insurances by monthly installments,

the easy way to look stat barred dates is the way the CRAs show

it is the date of the last delinquent payment (that is the date when the payment was

due and no further payment was made for 6 years (5 in Scotland).

Only a written acknowledgment can also restart the clock.

Does it show ''date started'' '' defaulted on'' and ''date last delinquent''?

I cant see any dates at all , except default date 13/3/06 below that is account status 2 red 8s and 10 green circles with question marks in them , last updated nov 11 below that is another line that says balance 4,411 twice then 10 @ £0 . I must say the zero balance is confusing as on the top it says balance 4,411
