    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.
    • was at the time you ticked it  but now they've still not complied . if you read up, here , you'll see thats what everyone does,

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

I am new to this, so please bear with me. I have got myself into a lot of trouble with money, I burried my head in the sand and put council tax bills in the draw. Unfortunately due my own stupidity and not dealing with this sooner I have now got an attachment on my earnings and apparently and enforcement officer.

I was paying £20 to these guys and then they put it up to £100, Came round to the flat, and told me I had no choice but to pay them £100 amonth as this is what the court has instructed. I told them I could not afford this, but they said tough. Cutting a long story short, I have a friend helping me sort out my finances now and she has written to them saying that I physically can not pay this as I do not have it.

I got this reponse.

Thank you for your email, the comments have been noted.

We are unable to amend your arrangement once your arrangement is signed and agreed to it must be kept to, failure to pay any later than your agreed date may incur further bailiff action

Yours sincerely

You would I think need to ask the court that

made the order for a variation of the payments

ordered because of hardship.

The Local court will be able to tell you what

you must do.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Have you verified exactly what is owed in CT with the Council ?(not the bailiff as they write their own versions of what is owed and what fees they can charge) you will need to contact them and get the following info.

1 - how many Liability Orders there are

2 - the dates they were obtained

3 - the address(es) they relate to

4 - the period(s) of time they cover

5 - how much each one is for

6 - how much is outstanding on each

7 - the names the Liability Orders are in

8 - the date(s) they were passed for enforcement

Then you will need to write to the bailiffslink3.gif and get a breakdown of what they are attempting to charge in fees.

"From:

My Name

My Address

To:

Acme Bailiff Co

Bailiff House

Ref: Account No: 123456

Dear Sir

With reference to the above account, Can you please provide me with a breakdown of the charges.

This includes:

a - the time & date of any Bailiff action that incurred a Fee.

b - the reason for the fee.

c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.

d - the name(s) of the Court(s) the Bailiff(s) was/were certificated at.

e - the date of the Certification.

This is not a Subject access request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

I require this information within 14 days.

Yours faithfully

Ripped off customer"

Once you have all this info come back here and caggers will help you solve this.

Meanwhile I suggest you pay start to pay the Council direct using their online payment system, if you can only afford to pay £5 pw then do so ..but..make sure you do this on the same day every week.

Court doesn't decide on level of payments for CT this is another fairy story fabricated by the elves at R&R.
