OMFG!!

 

Bad news! I have JUST this minute returned from the court as I'd wanted to see it in b&w for myself.....it is NOT what they told me on the phone at all, someone got their knickers in a twist on the phone & told me totally wrong info. The letter just given to me is as follows:

 

"The matter has been referred to the District Judge who has commented that the matter raised is a matter for the District Judge at the hearing on 2nd June 2006."

 

So, nothing has actually changed, except that the info I gave the judge will be bought up now. I guess that's something, where before 99.9% of claims were almost automatically granted a set aside, I guess at least he'll hear some strong evidence why it should not be granted.

 

Cannot believe the court can be so inept, I am so angry!!!!!!

Abbey: £4025 Claimed 27/02/06 - Paid in full 19/06/06

NatWest: £4529 Claimed 10/05/06 - Paid in full 1/08/06

Halifax: £1150 lba 18/05/06 - Paid in full 07/06/06

Natwest CC: £420 Initial letter 25/07/06 - Paid in full 08/06

Woolwich: £1100 Paid in full 28/2/07 + Default removed

NatWest Pt 2: £1700 Claimed 10/05/06 - Paid in full 7/2/07 + Defaults removed

Abbey Pt 2: £2300 + adverse credit removal claimed 23/03/07

Alliance & Leicester: £1421 + adverse credit removal claimed 23/03/07

Abbey-received DPA letter on 13/03, received some breakdown till 2004 waiting for the more recent ones(where most charges occurred)

sent reminder email on 17/4/06

called abbey on 19/04/06 to remind them:rolleyes:

sent another email on 26/04/06:mad:

Approx charges £2500

received £500 refund in dec 06

sent LBA

Capital one- sent DPA letter 17/03

Sent prim letter for charges of £260 14/04

Received a refund £109 awaiting further refund of £151

Settled IN FULL

Barclay card- Sent DPA letter 17/03 sent reminder 14/04

received info claiming £120

settled in FULL

i have sent my dpa request on 12 April and knowing my luck i will probably be messed around and end up giiving up. i admire you determination !!

8/8 CLAIM ACKNOWLEDGED GIVING THEM TILL 21/8.......

SETTLED IN FULL!!!!!!!

 

T MOBILE i won!

16/6 Data Protection Act SENT OFF

 

5/8 t mobile have failed to comply with the Data Protection Act/S.A.R - (Subject Access Request) reques ....BRING IT ON BABY!!

7/8 LBE SENT GIVING THEM 7 DAYS TO COUGH UP MY CASH

7/9 FULL REFUND BEEN SENT!!

Can the court really be as &*$^ing inept as Shabby?

 

Still, seeing as the charges are unlawful in any case, the best that this greedy Spanish institution can hope for is damage limitation.

 

I am still awaiting my DPA information whilst returning letters to them pointing out that it's not "my opinion" that the charges are illegal, it's a fact and that threats to close my account if I serve notice are also illegal. They have 8 days to comply now.

 

We'll all get our out of court settlements I suspect - they really don't want to open the floodgates.

Abbey - Won DPA Claim - Aug 06 and got bailiffs in to recover my court costs of just £30.00

Abbey - Won Charges Refund of £1050 - Nov 06

Egg - Recovered £220 due to Customer Services misinformation - Feb 2007

Nat West - Prelinimary Letter to recover on Credit Card charges £30.00 sent March 2006. £25.40 offered - rejected and the bank reckons that this is it's last word on the matter. We'll see if that's still the case when it reads my N1 form sent recently. It has until the 17th April to respond or the N1 will be submitted.

Sorry to hear the bad news. One thing that i am learning during this process, is not to get your hopes up. (sorry, that sounds really condecending - it's not meant to!) We both have had judgements made, warrants executed, and then for Abbey to flout the law and get them potentially overturned.

 

I suppose it is these tactics that will make alot of people say 'sod it' and give up.

 

Keep your chin up, stiff upper lip and all that. We both know that we will get our money back - it's just a case of when.

 

On the flip side. Just think, every day that Abbey fart arses around, drags their feet and is generally a pain in the you know what, interest is accrueing on the amount we are claiming, in my case a whole £1 a day! Who-hoo! OK, its not like winning the lottery - mind you, as i've only ever won £10, i suppose it's better than that at the moment, but it is something.

 

Bring forth the 2nd June .........

They could try an intelligent approach for a change:

Then again, there is no mention of bums, boobs or willies...so probably not!

 

 

Of course, it could be argued that thats exactly what banks are.....(or they could be the component requirements neccessary to create a "wunch")

I have only just found your thread and found it compelling reading. This is a bestseller! I was on the edge of my seat thanking God that I would read the outcome, then I saw you had to wait until 2nd June, then you didn't (phew!), only for a terrible twist of fate, you still have to wait. How you have kept going I don't know. Still gives you more time to sort your arguments out.

 

You are very brave, but then you have got right on your side. Are you getting your legal help from BAG, maybe a buddy, or are you doing all the legal bits yourself?

 

Got everything crossed for you, which could be a bit tricky for 2 weeks!:oops:

 

How about a coach trip to Aldershot on 2nd June folks? Perhaps MSE Martin Lewis might like to come.
