    • I live in a student house, with 5 tenants, unihomes is our utilities provider, who we each have a direct debit set up with and have paid each bill every month. Two letters were sent in my name by BWLegal saying I had two outstanding payments due adding up to over £3500, I have tried to contact british gas (as that is apparently our houses provider) as well as Unihomes. Nothing has helped and BWlegal are pursuing legal action if these debts are not resolved by the 1st May. What do I do? I've called Bwlegal when i bring up that the debt isnt for me and for unihomes they hang up on me. so I am stressed and do not know what to do

    • Hi, everyone. I received a letter from TfL investigator/Prosecutor. The letter reads as follow:   ''Thank you for responding to our enquiry letter. Your comments will be taken into consideration when reviewing whis case and we will contact you as soon as we have reached a decision. TfL now consider prosecution against passengers who are in breach of all TfL byelaw offences and I must inform you that further legal action may be taken. TfL byelaws can be found at ... Please do not hesitate to contact me if I can assist you further.''   The letter was sent 23 days after I replied to them. Should I send another begging letter to IAP? I'm extremely scared now. Thanks all.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just about to email the LLoyds CCT. we have amassed charges of £2000 over the last 2 years, mainly it was due to rolled charges if you understand, that and my husband being posted in iraq for a spell - anyhow, this is our main Joint bank account, we're part of an IVA (the account is not incl in this) but husband is cautious about claiming incase they close our account down as it's highly unlikely we'll get another - I on the other hand begrudge still being charge £30 when I go £1.21 over drawn - during a converstaion with a help desk lady she told me that the £30 charges would Stand (even thou I told her they were unlawful) but she said basically tough you shouldn't go over drawn they are our charges. :(:mad:

 

so about to email them now. has anyone been able to resolve this via email before?

Hi Lou,

 

If I were you I'd get a new account opened elsewhere as soon as possible - even if it's just a basic account. Check out the thread on Parachute Accounts. They probably won't close your account but it's better to have another account just in case. We got a new account open before we started the process and completely stopped using all of our Lloyds accounts. It really does help with the finances when half your money isn't getting taken in charges. ;)

 

I think that mjanet corresponded by email throughout the majority of her claim (her thread will now be in the Lloyds Successes sub-forum). I don't see any reason why it would be a problem to email wherever possible - probably a lot quicker than constant letter writing and sending.

 

Good luck and be prepared for whatever they throw at you.

thanks for taking the time to reply lucid. unfortunatly when we did try to set up a sedcond account after our IVA was started with the natwest we were declined. (this was about 10 months ago) main reason was so we had one account for bills and one for spending. anyhow I've got a personal account but no other jopint accounts, and apparently my husbands wages can't be paid inot an account without his name on it.

 

i'm prepared for a fight with them - I don't begrudge them charging me the £12, i'd happily settle for a lesser amount if all future charges were only £12 it's just I don't see it as fair they charge £30. still now we're more careful and have stopped being charged (well once in the past 8 months - which for us is v v good)

Hi Lou,

 

Assuming you emailed them on 24th September then they've had a week to respond so far - so they do have one week left. I'm not entirely sure how it works by email. We posted our letters and got an acknowledgement that they'd received the prelims within a couple of days of sending them. But it was pretty much on the last day of the 14 day deadline that they responded with their 'the answer's no' letter. I'd have assumed it would be a similiar system by email - so would expect them to at least acknowledge they'd received the email within a couple of days.

 

Maybe it might be an idea to send them an email asking them if they could acknowledge whether the correct department has received your email and remind them of the 14 day deadline.

Hi Lou,

 

Just out of interest do you know which department you sent the email to? I've slightly adjusted what you put in the above post - I hope you don't mind. :oops: I refer to an email contact for Customer Recovery as they seem to be the department who deal with this - but if that's who you emailed the letter to then you shouldn't need to include that part.

hiya,

 

I emailed [email protected] in the CSRC, I don't mind you altering the email at all - i'm not so good with wording emails to sound official etc.

 

thanks for your help. will send it now. (incidently it was the 3rd email I tried - the first two were either out of office or no longer employed by LLoyds. - maybe this claim is going to be doomed!)

Hi Lou,

 

Oh that's good, so you emailed it to the right department in the first place. They should have acknowledged the email by now then - the Banking Code states that they are supposed to acknowledge all contact within 5 days of receipt. You'd have thought that it would be much easier for them to reply to an email than a letter. :confused:

 

Hopefully they'll let you know what's going on soon. I'm sure it's nothing to worry about as they do have 7 days left to say that they aren't going to be refunding the charges;), but they should have at least let you know they got the original email.

You may be able to have your husband's name added to your personal account.

we tried to set up a new account, and just this week I tried to upgrade my natwest account, both were declinded due to our credit score - tbh its not so much the money - althou that would be nice, its the fact they charge us £30 per time when by all accounts it should be £12 max - somthing which capital one have informed us they now do (not that we use that account :))

My partners wages get paid into my account, its allowed as long as your partner signs a notification to his employer that this is his wish. After working in HR/Personnel for over 10 years I've never come accross someone being declined this!!

marie - he's in the forces which seems to be a law unto them selves! lol.

 

anyhow over 2 weeks now, and not even an acklodgement email, so going to post them the letter recorded delivery and wait from there - esp as they want to charge me £90 this month for going over by £10 on 3 occasssions. (in fact one was only £1.50 :mad:

 

any ideas on where to post them to? is SP del better than recorded?

Special delivery is better because the items are kept seperate from the standard mail and you are guaranteed delivery by a certain time - but it is ore expensive. Recorded is sufficient enough in my opinion.;)
