    • Hello, my name is Chris and aswell as saying hello, am checking my posts pop out nicely.  I have  an ongoing problem with British Gas(which shouldn't have become a problem at all), which has cannonballed into recently involving the Energy Ombudsman, Ofgem and I even, hasten to add our government because I am at wit's end. I have a couple of questions. What I write is likely to be mammoth size, I really would like to indicate why I am at wit's end, and as far as I am concerned (conjecture and opinion) its an indication of the inadequacy of our country's system that since and including John Major has been deliberately brought in to be such. Anyway hello and my 2 questions are ' Can I post photos and if so how, are there any instructions?'  and secondly,  ' To what extent can I mention names in what I post, first names only, second names? only, both allowed where known? quoting or gist acceptable, do I need to even though its case and should be anyway, state it's a truthful and honest account?'  It's been ongoing for over a year now on something which I am guessing should get sorted in maybe a month for most people, and I would actually like to go into fuller details than I've even said to them because I feel its important you know that I HAVE been significantly hindered and am living under that still as I speak/type.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there, I am new to this forum so forgive me if I've gone onto the wrong thread. A company called MMS uk have called my work over the weekend (which wasn't open, we're a school) and left messages to the effect of threatening to come and visit me at work if I do not contact them. They then called my work today (Monday) and spoke to the receptionist stating my name, why they were calling ( I owe them money) and that they want an address for me. Luckily the receptionist used her discretion and politely told them that she cannot give out that info and that they should not be telling her the nature of their call. She then inform me of the calls. This has upset me greatly as the headteacher does not allow personal calls on the work phone. Also the fact that information was given that should not have been. What can I do?

Yes I discovered it was Motormile! Well I phoned the number and threatened that if they phoned my work again I would be reporting it to the police for harassment! Haven't heard back from them yet, we shall see what happens now. Have made a complaint now.

You need to make that complaint in writing, stay off the phone, you probably spoke to the person in charge of filling up the polystyrene cups...

Hi ruthdoe96,

 

I'm fairly new here myself and have been in that situation with being contacted at work. Luckily for me I have "army personnel" working the reception desk and they couldn't get past them, but still got lots of calls at home. Once I got directed to the the cease and desist telephone harrassment letter in the library and it was sent off, they backed off and it has given me the breathing space I need to sort out my affairs and deal with these clowns. More than likely as Bazooka Boo says, you probably spoke to the person in charge of the "filling up the polystyrene cups..." and so it is best to get it in writing.

 

So don't let them intimidate you or make you feel ashamed. Being in debt, regardless of how long ago the debt was, is not a crime - if that were the case, the way we are going, the government would need to build more jails and I don't think we have enough land for them!

 

If anything else develops and you are in anyway unsure what to do - :help: - get yourself on here as more experienced caggers will be able to advice and steer you onto the right course of action! :thumb:

Ignore these leeches. They buy written off debts for pennies and then try to scare you into paying them...

They send out stupid letters and e-mails making out you are now in default with them, then it`s a home visit etc.

HELLO! THE ORIGINAL DEBT WAS DEFAULTED...IT CANNOT BE DEFAULTED AGAIN YOU CLOWNS! YOUR GETTING SFA... SO CRAWL BACK INTO YOUR MUDPIT!

 

Thats how I treat them ;)

I'v e dealt with these muppets in the past watch the doorstep visits as one of thier agents will call (did to my old address and pretended to be a bailiff to my ex neighbour to gain info thankfully she is wiley and got rid of him) the MD has an IVA look him up my advise is send him the tort of trespass letter and if they turn up call the police

I also am getting automated telephone messages from these clowns. After doing some checking up on this bunch, I found out they are really bottom of the barrel material. Losers chasing after written off debts...beneath contempt.

 

Well Mr Page and Mr Petty, your tactics do not intimidate me and i would dearly love someone to come round and visit me, they might not leave in a healthy state though since it`s trespassing without a prior made appointment and I have every right to use force to remove your goon from my property. You best send a very big lad round as I`m 6 ft 3 and weigh 18 stone :mad2:

 

I will be reporting these bottom feeding losers to the OFT and OFCOM for harassment.
