      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Need a wise owl to help me out!

Really confused as to what i am entitled too......had a meeting yesterday an was told i would be offically employed until August and would be paid until employment ended than letter posted last nite to say employment terminates on 8th July and only gonna get 4 wks pay and 3 weeks notice.....so confused what with other family issues dont know where to turn or what to do ....i thought redundancy went on age aswell.....been working for the same company since 2007 and im 42 and cant really find that much info on the web! Went to cab as soon as it opened but was faced with a two hr wait so walked??? Just does not seem to be any help about:sad:

Hello again Jan. I'm a bit confused too. Do you have another thread here about redundancy? I thought we'd tried to answer some of your questions.

yes i did but only just had the meeting yesterday basically he is saying he is paying 4 wks pay of my 15500 salary thats it but i just dont get why he said i would be classed as employed till August??????????????

So Jan, deep breath please :).

 

Can you post up what the letter says about your notice period and what they're proposing to pay please? Don't put in any personal details.

 

When you say you think redundancy is age-related, do you mean the statutory minimum? We may need to do the maths to see if 'x' weeks of your salary is more or less than the statutory payment.

We need to know on what date your employment started (month and year) to calculate what the minimum redundancy payment should be.

 

Basically you should receive one week's pay for every completed year of service up until the age of 41 and one and a half week's pay for every completed year of service since you were 41, so you could either be looking at (by my very rough calculations) £1043 or £1341 statutory redundancy depending on the start date of your employment.

 

Any notice would be on top of that, and it sounds as though you are required to work until 8th July and will be paid until the end of July, so 3 weeks after your last day at work will be your date of termination. Again, depending on the exact start date, this may be either correct or incorrect, as if you have COMPLETED 4 years service then you should receive 4 weeks notice at least. If the employer does not require you to work the notice period, then this could also allow the payment for this to be tax-free as well as the redundancy payment.

 

You would also be entitled to any untaken holiday pay, calculated up to the date that you leave as well - certainly up to 8th July, but possibly up to the beginning of August, although it gets a bit messy if your notice is being paid as 'pay in lieu of notice'.

 

As others have said, we need full details in order to work things out more precisely.

Hi there,

Firstly are you in a Union ? If so I would suggest speaking to them.

Secondly, if you are officially made redundant (and there are no options for redeployment elsewhere in the organisation) you

should receive pay up until the date of dismissal, this should include holiday pay - however just wondering if you can't take

pay in lieu are they including any annual leave in / upto you date of departure. Are you receiving statutory redundancy pay

or contractual redundancy ? Google "direct gov" on their website in the top right hand search box type in "redundancy"

also there is an interactive benefits advisor service which calculates DWP benefits and Housing benefit / Council tax benefit - type in

"benefits advisor" in search box and its the one that comes up top of the list - fairly straight forward - answer the questions and it will

tell you if your entitled to any help. You should at least get contribution based job seekers allowance - hope this helps, don't worry

it will all sort itself out.

Thx for all the replies x this is what the letter states and i started work in Oct 2007

 

I refer to todays meeting our redundancy consultation and the letter dated 27th May.

It is with regret that i must now inform you that your present role with the firm is redundant. This decision is due to the firm experiencing a downturn in business in recent months and our requirements to reduce our trading costs.

As you know, I have fully considered whether other vacancies exist within the firm but we are not at present in a position to offer you an alternative post

You are entitled to receive 3 weeks notice and you are not required to work your notice period

We confirm that the date of termination of employment on the grounds of redundancy will be 8th July 2010???? (umm thought it was 2011 myself!)

You will receive your P45 in due course and will be paid the following

Sick pay untill 17th June 2011

A statutory redundancy payment equivalent to 4 weeks pay (free of tax an NI)

An 3 weeks notice

Thats it basically folks x

So from reading that I am assuming that you are currently being paid sick pay and are off work?

 

On that basis, they have informed you that your sick pay ran out on Friday, and that you will now be paid three weeks normal salary in lieu of notice, as you are not required to work, which will take you to your effective date of termination on Friday 8th July. Your redundancy pay of two weeks normal pay (as this is slightly less than the statutory definition of 'a week's pay) plus one and a half week's normal pay (as you have completed one year's service over the age of 41) should then be paid (tax free). I see no mention of accrued holiday being paid, but that too should be due to you, however that is subject to tax and NI. You may need to query that if you have not used all of your entitlement up to 8th July.

 

Broken down, on 8th July or shortly afterwards, you should receive:-

 

Three week's normal wages, plus any outstanding holiday (with tax and NI deducted)

Three and a half week's wages (paid gross of tax)

Thank you sidewinder x They are saying i have no hols even though entitlement started in March and i have not taken any? I am currently of sick with depression following my dad having a major major op and trying to care for them both at present...... Just going to accept and be rid some employers have no respect for issues that go on in a persons life!

I understand, but if you wanted to you could push them on the holiday issue - sick or not, you build up entitlement and could make a claim for it!

hi again

 

more advice needed when i went to the meeting he said i was officailly employed until August when i got the letter i posted i texted saying i was confused as the letter states my employment ends 8th July.... this is the response to the txt

 

sorry about the confusion the notice given and paid is in line with your contract of employment

ie one week for every year employed up to a max of 12 yrs+

At the ime of the meeting i was not fully aware of the termination terms and i apoligise for any confusion this comment may have caused.

At the meeting he promised 3 months pay saved texted do i have a leg to stand on?????????????????????

 

**** on me from a great height why say something then change your mind????????
