I don't remember - but again a copy of a letter has been provided (see bundle on previous thread)   Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  No    Why did you cease payments?  2015   What was the date of your last payment? December 2015   Was there a dispute with the original creditor that remains unresolved?  I wrote to Barclaycard back in 2015 to ask them to send proof of the original agreement but they just sent me a reconstituted document which had no personal deals on relating to me   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? yes - step change took control and set up payments of £1 pm
    • I have had no such luck getting the tickets cancelled. So more help would be greatly appreciated. I have debt recovery letters now. I guess I ignore these and only respond when there is court proceedings?
    • On MCOL there are 2 times the case stay is lifted. Once between filing the defence and them submitting a DQ, and then again between them submitting the DQ and the court issuing one to the defendant.   Is that normal or is there anything I should be aware of?   Thanks as always 
    • It's difficult to advise what to do because there are so many ifs and buts. In the majority of cases where a PPC start a court claim they go all the way to the final hearing. However, in a minority of cases, and by no means a tiny minority, they have no real intention of going all the way to a final hearing. They know their case is rubbish and they know it will cost them a hefty wad to send a solicitor to court (remember solicitors' costs are capped at £50 at small claims).  They pretend they are going all the way to court to intimidate the motorist into giving in.  Yes, the pretence often includes paying the hearing fee.  Yes, UKPC often do this.  And no, they haven't produced a WS (so far). I suppose it depends on how much you have spent on flights (and accommodation?) and if this is refundable v the approx £250 at stake if you lose the case.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I have a 300k self cert mortgage at 7.99% which started in Nov 2008 (height of the credit crunch) I was in the middle of buying my ex out of the house and as i am self employed was left with no options as I was self employed.

 

My income has been variable but bank of Ireland were a nightmare from day one, not setting up DD's taking it without warning or not completing the mandate so I ended up with arrears from almost day 1. They also failed to allocate payments to my account. I have repeated complained about the way my account was handled and got the usual fob offs.

 

Anyway in 2009 I lost 5 big customers leaving me £80K out of pocket, then in 2010 another customer defaulted for £120K, the first 5 all went bust because banks called in their OD's and the latter is just a dirty bstard trying to dodge payment. How my business survived is a miracle however what it has done has meant I have taken my eye off my personal ball. I know you will find this incredible but I didn't notice for nearly 6 months that BOI were again not taking my DD various wrangling later in November 2010 we agreed I would pay £2k per month (£1750 + 250) by DD. They this time didn't set up the DD and then didn't collect any payments first I realised was in Jan I got a notice of hearing for suspended possession order, this was had in Feb. and suspended.

 

Prior to the hearing I paid 8K (4x 2K) in separate payments, the judge made this part of the order and ordered I pay the 2K per month amount. This I have done however 2 payments were a few days late because my bank didn't send them in time. I have letter of apology on both from my bank and sent them to BOI. BOI are now claiming they haven't had all the payments and have applied for a warrant to evict me on the 25th May. They are claiming the arrears have gone up.

 

This is a like a terrible joke and is killing my relationship not least my GF is threatening to take my daughter away. Any help you can suggest to resolve all of this would be appreciated.

Hi. you can defend the eviction by entering an N244 at court to get a hearing in front of a judge to have the warrant cancelled ( I can help you with that). Can you get proof that the payments they say they haven't had have been made? we will need that for your defence.

In the meantime you need to write to them by special delivery explaining what happened and enclosing the proof from your bank if you need help with the letter please let me know.

thanks for that I have the print outs of each payment and the letters/e-mails from the bank saying the the payments were made and apologizing for being late. What are the chances of success?

 

I heard today that the boi person is moving dept so basically I think he is just trying to get me off his desk.

 

I know this is a curve ball but do I have any options regards the self cert bit. As they are now illegal and its interest rate is punitive etc? Maybe reclaim interest in some way?

Sorry, I just realised I hadn't made myself clear. I have already sent them the stuff on 4 April (they confirmed receipt) and then paid them again in 11th April. I have spoken to the bloke at BOI who is truely unhelpful. I have copied him the latest payment from my bank when I heard they were applying for the warrant he has since ignored me. Are you saying I should do this again?

Yes and all the other emails etc. Yes got the warrant date is 25th may .

Affixed is the statement to go with Q10 of the N244. You will need to enter the info at the top where there are XXX's, (remove the xxx's) the info will be on the eviction notice. When you print it out make sure your printer is set for A4 paper (not Letter size), so it fits on one page.

 

Take a photocopy of the letters from the Bank - then write the Claim number on the top left hand corner and Appendix 1 on the top right hand corner.

 

These are the instructions for the rest of the N244:

1. Your name

2. Tick Defendant

3. Suspension of eviction

4. No

5. Tick at a hearing

6. 15 minutes

Agreed by all parties: No

7. Write - Not applicable

8. District

9. Both Parties

10. Tick box for attached witness statement

Cross out all options except The Applicant Believes

Sign and cross out all options except Applicant

11. Sign and cross out all options except Applicant. Enter your address and contact details.

 

Now assemble as follows:

N244 - signed

Statement - signed

Letters from Bank - Appendix 1

 

This forms the pack to take to court. Make sure it is stapled securely together. You will need to take a photocopy of it all for yourselves so you have a set to refer to in the hearing. When you take it to the court you will need to pay a fee of £40.00 and it will need to be in cash. The court staff should be able to give you a date for the hearing while you are there.
