    • She's an only child and he as a brother and sister. He has no will and we have done a check on this to find out if he had left one and nothing has come up. He has savings of around 28k His sister and brother are well off so 28k is nothing to them and aren't interested in his money. This just leaves my wife/his daughter. Would this still need to go to probate there is no estate e.g house or business to sell and the amount left in his bank is just small? When his wife died they just closed her bank account and moved her money across to his account and we just assumed that once my wife has handed in the death certificate and shown evidence of who she is the same would apply to her? We don't know yet the council have only just written to us today with a guide of what to do next.  
    • Did your FiL leave a Will and if so who is the Executor? Strictly speaking banks could refuse to take instructions until Probate is granted but In practice I would expect the bank to take instructions to cancel the DD if the Executor presents the death certificate and a certified copy of the Will
    • Hi   Sorry I probably wasn't clear enough. He had lived in the flat until December 2022 with Dementia by this time it was unsafe for him to have capacity to live on his own and he had to move into a nursing home. We had left it too late to apply for power of attorney so approached a solicitor in March last year for Deputyship. We were still in the process of dealing with it by May 2024. He passed away a few weeks ago and the solicitor was contacted to halt the application and we will just pay the fees of what work he has done up until now. My wife was the named person on her dads bank account but we didn't have the ability to alter any direct debits hence the reasons for applying for Deputyship as we were having problems trying to stop some payments coming out of his account Eon being another difficult company. We kept his flat on from December 2022 - August 2023. it was at this point I contacted Sancutary housing to inform them he was no longer living in the flat, it had been cleared out and was ready for a new tenant and that he had Dementia and had moved into a nursing home December 2022 and explained the reasons why we kept it on. As the named person to speak on his behalf I asked them what proof they needed in order to give notice on the flat e.g proof of dementia and proof that he was living in a nursing home and anything else they wanted. The lady in the upstairs flat and some of the other residence in the street had asked about him and we had told them he had moved into a nursing home. The lady in the upstairs flat wanted his flat for medical reasons so asked us once we had given notice could be let her know and she'll ask them if she can have it. We explained the difficulties and it was left at that but I did tell her I would let her know once notice was given. I contacted the company by email a number of times and also telephone conversations and nobody followed it up and it wasn't till the end of February this year that the housing manager for the area wrote to our home address to ask about him that he had been to the flat a couple of times and nobody answered and he had asked some of the residence in the street and they hadn't seen him for sometime. There was an email address on the letter so I contacted him and copied in the last 2 emails I sent Sanctuary regarding me wanting to give notice on the flat for at least 9 months explaining that it went ignored as well as telephone calls. I also stated I wanted to have his rent payments returned from the date I wanted to give notice which was from August 2023 as the bank wouldn't let us stop the DD without POT or deputyship explaining we were in the process of Deputyship. He gave some excuse about not having POT to cancel on his behalf and spoke to someone in HR and said he would contact the nursing home to confirm he was there with Dementia and if it all checks out we can give notice on the flat which came to an end on the 22 March 2024. There was not mention of back payments for the rent already paid or the fact I had asked to give notice in August 2023. Despite someone living in the flat from 1st April they continue to take DD payments for the flat and have taken another 2 payments of £501. another concerning thing despite Eon not allowing us to cancel the DD to his account the lady upstairs informed Eon that she was moving into the flat February 2024 and Eon refunding the account to his bank and said in an email sorry you are leaving us and canceled his account. Something they wouldn't let us do but a stranger. She also changed her bank account to his address despite the fact notice hadn't been given on the flat yet. So we need to find out how much information Sanctuary actually had for her to tell her power company she was moving into the flat in February despite the housing manager only just getting in contact to find out where he was. So a complaint is going into Eon and Sanctuary and we are going to take advice and ask the bank to charge back the rent. My wife hasn't taken the death certificate to the bank yet to inform them of his passing.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Update

Have not heard anything from GMAC, their call centre people say a decision has not been made yet. Someone told me that it had gone to underwriters as I have negative equity, I,e they would not make enough from the sale to cover erc and their costs etc.

so they may as well let me pay what was agreed in court.

 

And yet another month where I have paid them my whole salary, as they asked for extra to clear the arrears on top of the £100 that the judge ordered. I don’t know why I cant face up to these people, Got paid last Friday and paid Gmac most except 150 which I used to pay bills with. I have paid them an extra 800 this month.

Its gonna be a long weekend and month, and I do not have a single penny to my name. In fact I do not know how I will get home today after work,

My question is if they ask for extra money should I give them or not, as I have breached the court order I am trying my best to get back in line with court order before they make a decision.

OK relax you have certainly made an effort write to them over the weekend and tell them you are now reverting to the monthley payment plus the amount the Judge ordered you to pay you cant go on for ever with no money if they should take you to court im sure that you have done more than enough to keep your house

I think some of these people are having second thourghts we will be here to help just carry on making the payments it will look so much better IF and im not saying the will go for repossession if you have kept to what you have said you would do as Ellen says you do not know what happened next door Im sure things will work out

 

Yes I think some lenders are reviewing their policies and trying to see how they can be more sympathetic towards borrowers in difficulty,

Not sure about my lender.

You MUST tell the court about their unreasonable demands - they cannot make you pay more than the Judge ordered - that would be very good grounds for you to ask for a 'set aside' of the reposession hearing, ie it would go back to the first stage and be reheard.

 

PLEASE TELL THE COURT THEY ARE REQUESTING MORE THAN THEY WERE AWARDED - IT IS NOT ALLOWED AND THEY ARE THE ONES IN BREACH OF THE JUDGEMENT - NOT YOU.

Have just picked up this thread and I do sympathize with you. I have no legal experience but obviously the responses you have had are very sound and I can see you have anything and everything in your power to make the payments.

 

I noted on an earlier post someone mentioned changing your mortgage product - you have not said anywhere whether you have a repayment or interest only mortgage.

 

If you have a repayment then certainly changing to interest only (if they allow you to do that) will reduce your monthly payments substantially.

 

Just a suggestion and hope it helps.

 

Best of luck - stay positive and most importantly as the other guys have said - you really MUST go to work - drag yourself in if you have to.

I noted what sillygirl said. If a judge has already said what they can expect, they can't demand any more. Please inform the court, and tell them you've even given them every penny from your wages.

Don't forget to clearly state that GMAC charge up to £85 per month in "arrears fees" and this is not helping you get the arrears down. The Judge might also feel inclined to ask them to freeze all fees and NOT add them at any time to the mortgage.

 

Please please tell the court of THEIR blatant breach and ask for a re-hearing before they do... they will find they have shot themselves severely in the foot over their treatment of you.

Thanks everyone, for your support.

 

Sillygirl I hadnt thought of that before, If it goes for eviction I will mention that to the judge.I certainly will not be giving them anymore than orderd from now on. My sister has started work again this month so things will be much easier, We are able to afford the monthly payments together, the mortgage is interest only.

Don't forget that once you have paid the arrears off you need to go for a ''Notice of Discontinuance' which means they can't restart from 'eviction' if you fall into arrears again. They will probably dispute this but it is your right to get this stopped. They then have to start from square one instead of square three or four.

 

Good luck and keep us posted about this lot - they try all sorts of things and frequently mislead the courts over how much is owed to get their way.

 

You have now found the site that can help and give you the confidence back to deal with them at YOUR pace, not theirs.

The hour has arrived, have received a notice of possession proceedings,

 

God Help me, I have tried everything to keep this from happening,

 

Just called them and they say the warrant was authorised on 2 May and they are now waiting for an eviction date, does anyone know how long this may take,

 

Also they want the full amount of arrears back which they say are £9900. to stop further action.

 

I have explained to them that my sister has started working this month and we aim to be in a better financial position from now on.

 

Ok going to download N244 but can I take it in now before they have a date, or do I have to wait for the date.

 

My confidence has been shot to the floor and I dont know if I can win this one,

Any suggestions welcome.

Hi there, firstly - don't panic, you have to stay positive. I can help you with the N244 form. It's best to wait until you have an eviction date before submitting it.

 

In the meantime, do an income and expenditure sheet you can get one here:

National Debtline England & Wales | Personal Budget Sheet

 

Also, make a list of all the payments you have made in the last few months, especially where you have paid them nearly all your wages!.

 

We will write a statement to put in the N244 stating your situation is about to improve as your sister is now working etc. and how GMAC have pressured you into paying more than you should.

 

Try not to worry too much - I know it's easy to say, but you have to try and stay in control of the situation.

Please dont worry im sure you will be fine GMAC are Bast***d and so are their solitors just stay calm ell -en will help you with your defence allI can add is I fought GMAC fior years and I had this morning an appology from the HIGH COURT COST OFECE BECAUSE THEY HAD NOT REALISED THAT gmac ' SOLICTORS had made a mistake ;);) and they still owe me money but that dissnt help you

Thanks for the Support people. After reading several posts on here of people actually being repossessed, my confidence is still a bit low.

I have been awake all night, problem is I cant do anything now, Have to wait until I get the letter from the courts, trying to see if I can come up with any money to pay them. they say they want the full arrears paid back,

if it does go to court do I get the same judge I had last time.

I have applied for a work from home job and hope that works out for me so I can do it in the evenings and weekends, it will give me some much needed extra to pay of these arrears. I really want to have a fresh start and have them all paid off. do not think a remortgage is possible in the current climate, property value is enough to cover the mortgage but not ERC which is 11000.

 

Question.

After eviction you are still liable for payments untill the house has been sold, if you come up with enough to pay off the arrears, do you get your house back, does this depend on the lender, or can you ask the courts?

Yes you are liable for any short fall BUT that is not going to happen and dont let them pressure you into paying to much

what are your payments

how long is your mortgage for

is it repayment or interest only

 

lets try to sort ouy a plan to stop you worrying

My question is: If I do come up with the money to pay off the arrears after the reposession date, do I get the house back.

 

My monthly payment is £1,109 including £100 to pay off arrears.

Mortgage is for 25 years,

it is interest only.

 

the current value is probably about 215 000

mortgage is for 198000

 

I am now determined to fight this, they will literally take this house over my dead body.

 

Should I be getting proper legal advice on this.

Hi there, if you have an income and are able to make the normal monthly payments plus an amount towards the arrears you will not lose your home.

 

You said in an earlier post that you had taken in a lodger - are you getting the rent from this yet?

 

We can put together a defence for your N244 when needed.

 

Have you missed any payments since the last suspended possession order? If you have complied with the order and are paying more than you should I cannot see why they are going for an eviction date.

I am now getting income from the lodger, 420 per month.

 

Also I am in breach of the order by 1 1/2 payments. this is why I was paying extra. I do have an income, my sister will start earning from end of this month and we also have the lodger in.

Be a little carful what you say about the lodger some mortagae agreements state you have to tell them or ask there position I dont think it will be a problem as it is helping you to pay but just check the small print

Hi Bona at the last hearing I asked about it and Gmac's lawyer said it was allowed as long as it was below the taxable amount which I think it is.

And I did tell GMAC about this, they had no objection to it.

Re; my ongoing problem with GMAC.

 

received letter saying warrant has been approved and are now awaiting an eviction date.

I am still waiting.

I am quite positive as I have made last 3 payments plus extra, but am also extremely worried about losing the house, have seen threads from other people being advised to go to the council seek alternative accommodation etc,

Should I be doing this? If it comes to the worst ( God Forbid) I will not have anywhere to go, I continously lose sleep over this and cant wait until its over, although I have the strength to fight I am very afraid,

 

Gmac shall take that house over my dead body, I have now done all I posibly can to avoid this.

No Just remeber that GMAC say you are in arreas if you do not pay on the Ist of the month but the money is not DUE untill the end because you pay Interest in advance. You have done well and the court will see that when you get the notice from the court we will fill in a N 244 Im going to be away next week but wull go on line every day so can help if needed in the meantime start to make an income expenditure sheet and put together copies of all correspondence and payment. GMAC will say you owe more than you do its a game they play so be ready they dont get away with it youll be fine take care

I live on the Surrey/West Sussex borders, last time my CAB couldnt help me actually the lady I spoke to didnt know about the N244 form, I know they have someone in court but not sure if they can come in with me on the day,

Hi there, please don't panic. I can help you with the N244 form for submitting to court. Let us know when you have got an eviction date and we'll get it done straight away. I'm sure you have a good case for keeping your home.

 

Please try not to panic. If you are making regular payments and also paying some towards the arrears and can prove you are able to continue doing so - no judge will give possession to GMAC.

 

Try to stay positive.
