      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, hope someone can help,i defaulted on number of payday loans back in december, and have yet to set up any repayment plans with any of the companys, they are

 

Wonga - 1100

Quickquid - 350

Payday express - 315

 

I change banks for the time being, but payday express who have since past on to some else(cant remember at present who they are) have just taken £50.00.£25.00 £ 25.00 £ 25.00 from my account but i had no money in there but for some reason natwest have let it happen, but i cant find out till tomo as i have speak to lending but the women on the phone said they have had a few callls of late about this and have change how there system works, she also went on to say that it looks like i wont get charge for going overdrawn.

 

I have been worried sick about this seen dec and now this,i cant afford to eat let alone backing back 125.00 plus im sure there will be charges also

 

Can any one help or have a simuilar situalation???? i cant understand if there is no money in my account how or why natwest would or could let this happen.

hi, the first mistake was not dealing with this bank in December. Anyway, moving forward, i doubt that you will get the money back from whichever payday lender took it becuase you owed them the money and never came to an arrangement where you could prove different. Start by cancelling your debit card and then work on coming to arrangements with them where you pay them a set monthly figure.

Cheers for quick response, i have just cancelled card (i know now i should of done this in the first place ) as repayment plans, payday express said no straight from the off, wonga havnt even replied to numrous emails, but also have rang or contacted me anyway for that matter, quickquid are ok about a 3 month plan but want to do it by direct debt and im not to sure on that ?? can i trust them ?? cheers for the reply

So it could happen again???? These loans have been in default seen dec, so they must of tried before with no success, i would close the account down but cant as i have overdraft and now possible lots of charges as natwest now charge 6 a day and i have not got the funds to put in to get me back under my over draft. Its not looking to good

Hi, exactly the same thing happened with me last weekend and Natwest, but with me it was The Money Shop. It would seem that these payday loan companies choose Sunday to hit your account. I'd be interested to see what Natwest say to you about the situation. They took me £250 overdrawn on an account with no OD facility and had a nil balance to start with. Exactly the same tactics, several transactions of £25 and £50. Interestingly, the explanation I was given for the reason the payments went through - that it was a non-banking day and so smaller transactions will be authorised regardless, was put to the test by me yesterday when I tried to use my new card with only a few pounds in the account. I attempted to use he card for a transaction that would have taken the account overdrawn, but it was declined - twice! So how come these paydays loan companies can get away with it?

chillout now!!! Well rang natwest today and i must say what a total waste of time that was, first lending said i borrowed the money and gave my card details out and they were doing what i had instructed them!!!!

Then spoke to visa debit department and they were pretty much the same, the money came out on thursday but i only realised until sunday, i think the money shop is payday express!!! Well card barred now so on to getting a repayment plans set up. Cheers for the help i really appreciate it
