    • Yeah well it's been a busy and stressful few weeks. I also wanted to see if they did anything while reopening the claims.
    • We don't know of anyone on this forum who has had RLP organisations or bailiffs arrive at the door. They're going to threaten legal action because they think you may not know that they aren't able to carry this out and could be more likely to pay them. HB
    • Has anyone that you have known or posted on this forum received knocks on doors from them or received a ccj and been sent to court or have sent bailiffs or gave the debt to another company. if they don’t have any legal powers why do they threaten with court action 
    • Ok, so just been to see my friend, she still has her head firmly in the sand and had a pile of unopened post, thankfully nothing serious apart from this case!    In answer to your question it says N24 General Directions Order at the bottom of the page, then on page 2 where the line says "As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court) " this is N271 Notice of transfer of proceedings.  Within the stack of letters I found 2 from Kearns Solicitors,    02-12-2022 Document pack with covering letter stating under the s78 CCA please see enclosed  1) A copy of the executed Credit Agreement, 2)  A copy of the terms & conditions 3) A copy of the varied terms & conditions applicable at termination / assignment, and  4) A statement regarding the conduct of your account as requested by s78(1)(a) to (c)  (Would you like me to describe the documents attached?)   18-02-2023 Generic letter asking for her to contact them to discuss settlement or they will take to court for further legal action.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had a loan with Santander and owe 19266.71 . I had a notice 7/10/2010 re arrears on this . I had recently remortgaged so was/am in a position to pay .

I received a letter from Capquest 9/11/2010 . Claiming the debt had been referred to them .

The amount they request is 26236.05.

 

They claim this is interest !!

 

I am happy to pay the original amount . What can I do ?

Can anyone help please or point me in the right direction .

Hi,

Before you offer anything, I think you need to find out whether CQ are collecting on behalf of Santander or whether they have bought the debt outright. Usually on the letters, if it says to make payments to CQ then they have bought it and if it says make cheques payable to Santander, they are collecting on behalf. Also, thier letters may say 'their client' which says they are collecting for Santnader.

 

I would also be questioning where they have got their figures from. I suspect it is a referral fee which (in my opinion) is exhorbitant that has put the balance up so high.

 

A few more details would help. How long ago did payments stop? Are there any charges on this? Did you receive any letters from Santander before CQ started calling?

Thanks for reply . I made my last payment on loan was £81.11. 28/8/10.

I received a letter from Santander 7/10/10 . requesting £ 19226.71 . I was in process of remortgaging and contacted Santander and told them I would clear balance within a month.

Then on the 9/11/10 Capquest wrote . They request payment to them .

I would do a two pronged route. First, write a letter to CQ asking for a breakdown of how they can justify a rise of nearly 7 grand and that as you had been in contact with Santander (albeit one communication) this account should be referred back to them.

 

Secondly, write a Formal Complaint (and headed as such in the letter) Santander asking why they had transferred the debt to a DCA when you had offered to clear the outstanding balance.

 

To me, this seems like a ruse to get more money out of you. When you clear a loan early, you should get a rebate. By passing it to a DCA they might be trying to get out of that.

 

I would keep the settlement amount safe somewhere( gaining interest) until you can resolve this.
