    • Evening all looking for bit of advice again , currently doing my own debt management , but think may have burgered up on 1 of the creditors (creation loan) had got sold to Intrum around nov 23 , it never went to default ( I thought it did  , now checking credit file , intrum is there and says 1 missed payment and doesnt say account defaulted can i let that go and intrum will default it? hope that makes sense what i have said

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Do you suggest I write a further letter to Cardif Pinnacle refuting their decision to pay me the money due for being unfairly dismissed?

 

Also, does it matter if I complain to the FOS more than 8 weeks after my initial letter from A+L (received yesterday) - I presume there is no time limit on this?

I sent my letter to A+L advising them my PPI had been missold and I would like my money refunded. A week later they sent letter back (well Santander did) advising they were sorry I felt that way and that they would conduct a full investigation and get back to me. Should I wait the outcome of their investigation which will probably come back with negative results on my part or should I write another letter saying no, I was fairly missold the policy and I want a refund of all premiums paid?

 

Any advice greatly appreciated. Thanks

Received a reply from Santander saying I'm not getting anything. They have sent me copies of the

documents I signed at time of mortgage saying that the situation would have been well explained to me at time of taking mortgage hence me signing forms! I am still adamant though I only signed as I was desperate for the mortgage and was told in no uncertain terms that I wouldnt get the mortgage if I didnt take the PPI!

 

Part of the letter says that I was sent a Keyfacts document stating that the insurance was optional :-x and not mandatory to receive the mortgage. This was certainly not what I was told at my meeting prior to signing all paperwork! I am livid!!

 

What next? Shall I respond to Santander or go straight to FOS?

well they would say that wouldn't they.

its the local adviser that gets the commission i bet!

 

i'd write back stating that as they were not there, how can they make any assumption upon what you were told in a private office.

also pointout that it has come to your notice that the selling of PPI insurance was commission based as well.

I got the FOS to investigate my complaint about the mis-selling of PPI and they have come to the conclusion that because I ticked the boxes wanting PPI (after being told by the advisor that if I did not agree to it I would be refused the mortgage, I absolutely thought this was just what you had to agree to to get the mortgage at the time they way the advisor presented the information to me hence me agreeing to it because I thought I had to). I wrote back disagreeing with their decision and they have refused my complaint again. In no uncertain terms did she say the above and I firmly believe the PPI was mis-sold to me. Should I ask for another independent investigation or do you think I should just leave it. I am so angry, especially when I saw in the news last week that Barclays are paying out on customer complaints, no questions asked .............................

The thing is, the guy investigating the complaint at FOS is so nice. He has given me more time to get back to him saying why I disagree. My partner was with me in the room at the time I got the mortgage so I have instructed an independent precognition agent to take a statement from him so I can submit that in my defence as my last resort.

 

the guy at FOS says that because there was not a video recording, he has to go on the fact I ticked and signed for it therefore I agreed to it. It's like he knows I am telling the truth though every time we speak and always gives me time to get back to him and he said I can also have another FOS person investigate my case if I am not happy.

 

Would going to court not be quite expensive? If I did go to court and won, would I only get back what was due or could you end up with more money and if I won, would Santander have to pay the court fees?

Depends how long you want to keep going back to fos really. Its your call at the end of the day.

 

Small claims (under £5k claim) isn't expensive and you'd get those fees back if you get judgement. You'd get your ppi payments back plus appropriate interest.

 

You'd have to prepare your case properly in the event that you might have to appear before the Judge if the other side defend. On the other hand they may cave in before a hearing but don't rely on that. If taking court action, good preparation is essential.

Okay. Thank you very much for your help.

 

Hopefully if I provide them with an independentlly obtained statement from my partner, this will prove that the advisor gave inappropriate advice that day as that will be two folk disagreeing with what the advisor said. It's so frustrating!!!

 

I'm not giving up as they failed me with the unfair dismissal thing also ie by not giving me my money which was due to me when I won my case so they have failed on two accounts here, not just one!!!
