    • Does anyone know if I would be allowed to record conversations with health professionals for my own use on my phone without them knowing. I know that we are allowed to record phone calls. I do record some of my phone calls for my own use due to my disability and if anything is said then I am covered. I would only record audio in private area's of myself and the professional dealing with me. I know I could not get and other persons audio in it and I don't intend to. my only other option is to buy a body cam but I am not sure the rules regarding this.I never thought i would have to but things are getting worse Thanks for any guidance

    • Ok thanks for that, well spotted and all duly noted. Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello guys , been away from here for a while to be honest i lost a bit of faith in the whole thing as i wasnt getting anywhere slowly.

 

Anyhow today i recieve a letter from The FOS and Welcome informing me my PPI Complaint has been upheld and is justified . They have offered me £928.69 which is my PPI refund plus 8% interest.

 

It states that total compensation offered is £928.69

as your existing loan agreement has expired(Passed the date by which it should have been repaid) My offer is to apply the compensation as follows:

£928.69 to be used as a payment to your existing loan.

The figures quoted are correct at time of printing

 

The Date of offer is 10/9/10

Its states , Please respond to this letter by letting me know whether you accept or reject my final decision and my offer of compensation. I enclose an Acceptance form for you to do this , together with a pre-paid envelope . My offer will remain open for 14 days. If you do not respond within this time i will consider the matter closed and will take no further action unless i hear from either you or you.

 

Now heres my gripe , I recieved this letter TODAY 29/9/10 The envelope it was delivered was franked 2cnd class with NO Postal date or sender address. And guess what the 14 day date has expired. As i got home after6pmm the office was closed to discuss this matter. There was also No Pre paid envelope enclosed . I will be returning my letter of acceptance via signed delivery tomorrow after i have made a phonecall to welcome and the FOS.

 

The thing is i know my account will then be settled barring a payment of £80 BUT i think they have got off scott free as i have paid nearly £5000 back for a £2000 loan. Im going to accept but a financial benefit will not really be felt by me.

 

Thank you to everybody who has been a help to me and any further advice on this matter would be much appreciated.

I had something similar but will be turning mine down - for other reasons.

 

I don't want it to effect other claims i have against them for same agreeements, and some of the figures are dubious.
