    • Hi there   thank you for the reply. No, it's not a silly question at all. I am convinced I didn't hit anything with my car. I was going very slowly and it was the guy standing next to his lorry in the road who punched and kicked my car as I went by. It's cause I saw him do it in the mirror.  I initially thought he did it because he thought I was passing him maybe too closely whilst he was messing around with his lorry ?  That's why I stopped and got out and asked what he thought he was doing hitting my car. He then just hurled abuse at me. Not making any accusations such 'you hit me' 'you hit my lorry' or you did this or that. He just swore and shouted at me. At which point I said I would be making a complaint to his company for his threatening behaviour and vandalism for punching my car. I went to my car , got my phone to take a photo of his number plate but then he came towards me again and I thought if he now hits me I am going to come second. I am a woman in her mid 50s travelling on her own and this guy looked like a Millwall football supporter (short, rotund, skin head) so I decided to leave this situation. I got back in my car closed the door and drove off before he could reach me.  I later checked my phone and noticed the photo was too blurred, as I turned and rushed back to my car too quickly before the camera could focus. So I thought it was pointless making a complaint as the guy couldn't be traced anyway, so I forgot all about it until yesterday. But this is all I can think of, it must have to do with this incident as it is in the same street.   
    • Please read the following thread very carefully. It is extremely relevant where you are suing Evri on the basis of a contract which you originally made with Packlink who are domiciled in Spain. A judgement has been obtained and we have applied for transcript and it will be put up on this thread as soon as we receive it probably about the end of July.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

halifux are now part of loyds banking group, so is maybe prob just going there for internal 'admin' purposes.

don't worry, just continue payments.

could phone them up to double check and that your SO doesn't need to be changed.

It does not make sense the change from BOS to BLT with 3 payments to go.The last time I checked LLoyds and Halifax had separate trading licences.

 

I think this is a case of go with their arrangement,as I feel we are reading more into this than needed.

 

You are still dealing with Halifax as the OC,the other 2 BOS and BLT are just mouth pieces for the group,the debt has not been sold,it really does sound like an internal adjustment

update - I went into the branch and the lady who served me didnt have a clue, tried to tell me that their systems had been updated and as such was unable to access the account. She told me tha the account had been sold to another debt collection agency and could not help me! I soon told her that it hadnt and that BLS were in house team. We eventually got through to BLS who gave me the ususal 'increase payments, settle acct ' crap. what was more interesting was that I was told that as the account had been passed to collections once the overdraft is paid they are closing the account and end of story - are they allowed to do that?

Have you considered making a subject access request to the Halifax.. you should specifically request statements.. as well as the other stuff mentioned in the draft letter in the CAG library. It will cost you £10.00 and they have 40 days to comply.

Hello everyone, I wanted to update my thread and to ask for some futher advice if I may!

 

Well the time has come to pay the last installment of this wretched account, after paying back over £3,500 majority if which is bank charges we have £123 left to pay. This wil be cleared at end of Jan. However we have been told that this account will close once we have cleared the overdraft- can they do this? we dont want to lose the account? any help on this would be apprecaiated.

 

On another matter of the charges, am I right in thinking that once we submit a SAR that we can attempt to claim back the charges that they have slapped on this account over the years?

 

I look forward to hearing from anyone!

Sadly yes they can close the account..

 

If this is a current account, then I think you would have a hard time reclaiming charges. However, it might be worth your looking at the BCOB articles which can be found in CAGmagazine, but I have linked them below for convenience.

check your credit files. it may be down as an 'arrangement to pay' or the likes. once paid, it should be marked as 'satisfied' or similar. which is better than unsatisfied re a credit check. but, in any event your rating may not be the best due to the 'arrangement'.

can we oppose the account being closed? Is it in our favour to have it closed? or will it do our credit rating good to close it?

 

I will try and find some answers to this question. I really dont know !!
