    • The letter is standard.  Next you will receive a Directions Questionnaire from the court. As scribbled before, we know Countrywide well.  They are a very small cowboy company with we think just two people working together.  They know nothing about the law but are convinced of their own importance and that they are right.  This means two things. 1.  They are highly likely to pursue this all the way to a court hearing, because in their minds they are sure they will win. 2.  They are exactly the sort of "arrogant idiot" you want as an opponent in court.  Simply thinking you're an important person who will automatically win is a recipe for disaster in court.  So far their win rate against Caggers is exactly 0%. So time to start building up a case against them. 1.  Are the photos of the vehicle really as bad as what you have uploaded, taken in the pitch black? 2.  How long exactly was the vehicle in the car park? 3.  Is this place local to you?  If so it would be a good idea to go back there just before dusk and take photos of the signs both in daylight and at night.  They are bound to be confusing and designed to entrap motorists, as this is their M.O.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have started this thread on behalf of a well respected Cagger. The details are below.

 

If you have visited, stayed at or a resident of BALMORAL GARDENS Bexley Kent, and received one of their 'invoices' please post the details of what happened etc, did you pay it , contest it or just ignore it.

 

We are interested in finding cases of where you have had Letters claiming you owe us blah blah etc from PARKFORCE.

 

If you live there or visit, information that you need to know.

 

1) PARKFORCE do not issue the TICKET they come from on the estate, but there is a cover-up of who is plastering the cars.

 

2) PARKFORCE only act as a DEBT recovery agent for the mystery person putting the tickets on the cars.

 

3) The tickets and signs are bought from PARKFORCE as a package; once again our mystery person did this and gets the new tickets.

 

4) My interest was in the past we were visiting family there and went in 2 separate cars, only one of the cars got a ticket, and my sister tried to appeal it, but instead, received demands increasing every time.

 

I need to find out more about just who is the mystery person behind these self ticketing scams, before we take legal action against the [EDIT], no one on the estate will answer questions, other than we have yellow lines and you get fined if you park there ( remember this is private property )

To protect my sister and her identity I have asked the mods/site team to post it.

 

As I already know how the whole thing works, what we are after by contacting anyone else that has been scammed or may be in the future, most of all just who the mystery person is because he is the one causing grief to many innocent people.

do we not have something similar with OPC near dartford or close by

 

be interested to know more about this,

 

but by reading it there are reasons not to identify people concerned
