      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I can't see any box with 'Your right to cancel'

So IMO I would say it is unenforceable, others will hopefully be able to confirm this.

Just read the letter they sent and apart from the usual immature threats I had to laugh when I read the name the computer used to sign off the letter "J.Horner" Not THE Jack Horner who sits in a corner eating his Christmas pie....

 

I do hope you haven't ignored them and have called them? Otherwise they get very angry and the coloured crayons come out!!!!!!

 

Personally I would fill in their I&E form and fill it with zero's, OR, make up your own I&E form and ensure you list the following;

Personal Chauffeur wages £150 per day,

Cleaning staff x 8= £800 per day,

Private Jet hire £25,000 per hour,

Cheese & wine & caviare Parties x 4per month £18,000 ea.

Running costs of private helicopter with pilot, £85,000 per month.

Cost of stationary and postage to amuse debt collectors, £1 a week...

It is very simple, they don't get to see your private I&E full stop.

Ask them which district judge has requested your I&E so that he can view it and advise them accordingly as to how much you can afford?

Or tell them to get down off their high horse, and that YOU will tell THEM how much YOU will pay THEM, if they don't like it to take you to court where you will gladly allow a DJ who is suitably qualified to view your private information, either way the muppets aren't getting anything, you have their bank details, just go ahead and set up the standing order paying them what YOU have decided you can afford. They won't be able to take any legal action.

Rebate is how much you would get back if you pay this off earlier than expected.

Oh well, start the complaints process to the FOS, inform them that they have issued a DN in response to you not jumping through their hoops.

No can't say I have heard of them previously, albeit another Scottish law firm.

I am very surprised that they are foolishly wanting to act on this debt, especially as you are paying what you can afford to it??

Beggars belief, IMO file it away, and as long as you maintain your affordable payments there is very little they can do, a DJ will NOT make you pay any more than what you can afford, you might like to lodge a complaint to these guys;

Why would you want to show willingness on your behalf, when you are paying them what you can comfortably and realistically afford? It does not matter if they foolishly take you to court, the DJ WILL NOT make you pay anymore than you can afford, ignore them, I would not reply to them and I would most certainly NOT tell them that you might be able to increase the payments. You have a life to lead, so invest the extra money in a social life or on yourself, this is NOT a priority, it is a poxy consumer debt, so what , we all have them, they are not on my list of priorities, if I have some spare cash then I spend it on me, and maintain my current payments to these vultures.

You have answered your own question Chat, you are paying them what you can, token payments or not, they will look extremely foolish, more so than they do already, if they were to put this in front of a DJ seeking more money!

When you will be able to show the DJ that you are already paying what you can realistically afford to, this IS NOT a priority debt therefore it takes the back seat when you have other more pressing obligations to pay, such as your rent/mortgage, council tax, court fines, utility bills etc.

You could write to them if you want and TELL them, that they should think themselves bloody lucky they're getting anything at all, and if they persist in moaning about it, you will reduce your payments even further, as one Judge ordered an elderly couple to make a payment of 50P a month!!

 

Their really is nothing they can do if you are paying what you can, ignore them, and just lodge complaints about them to all that you can think of who police these financial institutions, and DO NOT forget, WE (the public) OWN that bank, keep that in the back of your mind whenever your dealing with them..

You might as well declare your self Bankrupt rather than be tied to an IVA, IVA's are a very very last resort, after you have had plastic surgery changed your name and moved to the costa del sol!

Greed Chat, if they push for an IVA you may as well go BR, IVA's are no better and will drag on meaning you will end up paying more, so BR will be your trump card if NR (which is our bank) continue to play you for a fool. It won't come to that anyhow.

I'd be inclined to complain about NR and their time wasting throughout all of this! If you have made the same offer all along, which they have refused all along, then suddenly they take it to this stage and are suddenly accepting of it? Then there is clearly some abuse of process here? It would definitely merit questioning...
