    • I purchased the vehicle using finance through motonovo under a HP 60 months agreement. I have now amended the document ensuring all is in black. Unfortunately, this email has now been sent. However, I have not sent a letter to big motoring world. Also, I have taken the section of the firealarm issue. I am struggling to convert to PDF. I am not tech savy at all. My mistake was that the the salesman was very fussy on a sale. We went down a quiet road for a little test drive and not for a lengthy road test. The water issue was not present at this moment of time. However, it only became prevalent after driving away, after all docs signed. I did stated to Audi I wanted a diagnostic report. However, they carried out an Audicam which is footage of the issue. Audi have diagnosed the issue as a common issue where coupes/cabriolets accumulate water in the seals. However, I did state beforehand for no issue to be rectified due to me wanting to reject the vehicle. I am awaiting a report from Audi through email from the branch manager in relation to the issue. The issue so far is the water still being present in the sills. Audi tried to fix the issue however the problem is still prevalent. Regards

    • Right,  so the court hasn't send out the Directions Questionnaires/N180s yet. PE's one is a false one, meant to intimidate you into thinking your defence was rubbish and they are confident with their claim. This is par for the course.  The PPCs do this regularly. However, PE have gone further and written that "a copy has also been filed with the court" which is a lie as the court haven't even sent out the papers yet. Keep a screenshot of MCOL, later on in your WS you can draw attention to their lying and abuse of court procedure. If you've got time on your hands, then complain to the BPA about one of their members lying.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Pretty new around here but having taken lots of c*** from banks and other institutions I've decided to start fighting back, including reclaiming charges, now I'm looking for a little advice on this.

 

I am in arrears on a Capital One credit card. I have written to them (already told them I will only communicate by post!) and made a reasonable offer of monthly repayment. They have ignored the offer but have now written to me saying that they are no longer dealing with my account but have transferred it (their words) to FPC, a dca.

 

What's the best advice on what I should do next? Has anyone had dealings with this company and what should I expect?

Don't sign the letter, print your name or use the digital signature on here, capquest are one of the worst for harassment, if they do ring, tell them that you are making notes of the number of calls they are making and then put the phone down and send them the harassment letter from the debt collectors library.

 

They have 12 + 2 days to comply with your request for a true signed copy of your agreement after which point the account will be dispute.

I will get off the cca today. Yesterday I received a big yellow card inside an envelope from FPC. In big letters across the card it said "Address Confirmed" and then lots of bumf about them confirming that I lived at my address...not that I ever said that I didn't!!. Obviously its an implied threat to send someone to the door..:)) I've already written to them telling them to only contact me in writing, using the template letter.

 

I also had a TWO letters from Capital One. One from Graham Robinson replying again to my offer of payment and simply saying that the debt was now with FPC and one from Sven Lagerberg regretting that my PPI on the agreement had been cancelled by me...but I didn't do that, THEY did, when they terminated my agreement. Is this normal?!!!

 

Btw, when the debt was passed to FPC, should I have received any sort of notice of assignment?

 

I'll keep you up to speed with developments...and thanks again for the advice, much appreciated!!

Yes totally normal behaviour for Crapquest but who are FPC? Have to say thats a classic name Sven Lagerberg. Yes you should have had a letter of assignment from the original creditor, a nail in their coffin. Might be a good time to do a Subject Access Request, £10 and don't sign and this goes to the OC. Well done dealing with this so far and we're here if you need us. By the way when you get a copy of the agreement use a free photoimaging site such as photobucket so the peeps on here can give their opinion as to enforceability.

Miss Muppet, it is FPC, not what I put in the title, sorry :((

 

There has been no letter of assignment, just letters from oc and FPC to say FPC are now looking after this account.

 

I sent off the cca today to DCA, let you know when I get a reply.

 

So Sven is well known?!!..really odd to get a letter that was almost sorry that the PPI was cancelled when it was CapOne that caused it to be cancelled!!

Sven isen't well known to me:D I just think it sounds like a made up name, but then most of Capquest's are (I know yours is a different DCA - where are they based BTW) they have a person called Barry Davis who is constantly on holiday or in a meeting when Caggers who have been issued with SD's call to tell him they are going to get a set aside!

Just make sure the 12 working days have passed since they received the request

 

Also, it doesn't matter that Cap1 cancelled the PPI. If it was mis-sold to you in the first place, you can get it back.

Have you sent Cap1 a SAR yet?

So I should send this to FPC? The last letter from Cap 1 said that the whole account had been transferred to FPC and was no longer in their hands.

 

I haven't sent an SAR to Cap1 yet. I was first waiting to see what the response to the CCA would be...and the answer to that is nothing!

Just when I said it had gone quiet I had a letter on Saturday from Sven Lagerberg, "Head of Executive Response Centre" (!!)

 

This says that Cap1 are "looking into my situation and will do everything they can to get an answer to me within four weeks"...!!!!

"If for some reason our investigations take longer than four weeks we'll contact you and tell you why this is.."

 

Don't they realise they have a statutory time to reply? ...or is it that they simply can't find my original application form?? I originally applied around 2003.

 

Sent off letter 20 as suggested and I'll keep you all up to date with developments.

Any update on this?

I am stuck in a very simliar situation involving both companies

 

I have been issued with a default notice 3 days ago, and saying Capone will be passing my details on to a DCA

then recieved a text yday from FTC

 

I rang Capital one who didnt want to take payment and said to me Capquest will be in touch

 

I missed 3 months payments due to falling on hard times,

I havent yet recieved written communication from FTC or Capquest, just calls from FTC which I answer and hang up

 

I have started a thread but no response yet

can you advise what I should do next
