      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

When you say application costs do you mean the £75? If so then no I didn't ask for it back, as thought I would get it back automatically if I win, but if I am wrong about this please let me know. And I am not counter claiming anything, just want them to leave me alone really. I'd rather keep it simple, don't want to go in too far over my head you know.

But I have already sent the n244 form off to Northampton County court, they then sent me a letter saying it was transferred to Staines County Court (local), and now Staines have sent me a letter saying the hearing is on the 1st September. I'm sorry but I don't understand what you mean by "wait for the claim form to be served again and then counter claim against them". I do apologise, I'm not very brainy on these types of things.

So got an email in the post today... Court date is 1st September at my local county court. I need to start rolling my defence together. Is my defence going to be the same as what I sent to get the judgement set aside then? Any idea how long before the hearing I should be receiving the evidence bundle from OPC?

Send AL27 a pm with a link to this thread he will help you with your defence. He has won every case against OPC so well worth yourwhile.

I am sure you cannot just 'withdraw' a CCJ, you need to have it set aside or it is still live and if you don't settle it within 28 days it will go on your credit record and cause all sorts of damage. Please check.

I didn't withdraw the CCJ, as my management company confirmed that I own the parking space OPC had to withdraw their claim against me as it's farcical and they no longer have a case...if they had one in the first place.

 

The frustrating thing is that now they've issued court papers to my gf too, but I've yet to see them myself. I'm assuming that they are as they were too happy to try their luck against me. I feel really bad for her as she's/we've got this stress to deal with due to me advising her to ignore all OPC's correspondance. I've asked AL27 for help again!

Sorry to hear about all the stress this is causing your girlfriend, AL is the guy for OPC they haven't won a case against him yet, in fact I have heard they have a contract out on him;)

let me get this straight

 

All the OPC letters went to op's current address?

 

but the mcol court docs went to past address so they could get a judgement by default?

 

Good tactic. Looks like same thing a bailiff company would do.

 

 

Surely thats contempt of court as he can easy prove they knew his current address?

Hey guys...

 

So I've got my court date on the 1st September, and still have not received any information from OPC about their prosecution. When can I expect this through, and how long must I wait before I should ring the court and inform them that nothing has been sent to me? They have my defence because I sent to copies to the court, and they have sent the copies to OPC i believe.

Nothing. You turn up to court and tell the Judge that you've not recieved any documentation from the other party (despite ensuring your was sent in in good time). You ask for the action to be struck out for non compliance, OR if they are unwilling to do this, a continuance so that you can assess your response.

This is just to set the judgment aside. The court has the defence we'd use should they grant a full hearing. They may ask why you think you've not had any communication from OPC and it would be a good idea to point out that there have been a few people on internet forums that have had default judgments out of the blue, sometimes going back years.

 

Don't worry about OPC at this stage.

Thans guys. Well what I'm going to do is print off copies from this forum of people who are saying they never received any claim forms initially, just the default judgement. If anyone here is in that boat, can you post in this thread a small paragraph about what happened, just incase there are more that we don't know about. Thaaanks!

Ok so received a package from OPC today with their "evidence" against me, basically some photos of my car parked in an access road which has no name. The witness statement is signed but the date field has been left blank, and their witness statement is flawed, in that they say I phoned them to tell them that my mother was not the owner of the car, I was, when in fact I have never contacted them by phone and instead sent a letter saying that their records were not correct and that I was the owner of the car.

 

Another wierd thing is that they have sent me evidence they plan to use against me for 6 different alleged contraventions, when the claim is only for one parking ticket, so I don't understand whats going on there!? Finally they have sent me a copy of ALL the letters they and Windsor Smythe have sent me, and guess what, including the unstamped claims forms from my local county court. So what do you guys suggest my next step should be? Just study my defence solidly and go into the court room and use that?

 

Last thing is that they state I was parked in a parking complex, on a certain road, when infact where the car was parked is an access road that has absolutely no name, and which is connected to a different road to the one they say I was parked on. All seems really strange to me.

Oh and lamma, i phone Northampton County Court and asked them if they could give me the address that the initial claims form was sent to, and they asked why, and I said because I never received it, all I received was a CCJ by default, and the woman then said well if you received the CCJ, then the claim form must have been sent to the correct address. Me being me just accepted it. Do you think I should call them again on Monday and demand the address the Claim was sent to? Or just leave it at that?
