    • Today , after a lotof years i recieved a letter from this lot. Very friendly, "Were writing to remind you that we havent had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. uP TO 2000 I hadsucessfully gotten deferment on low income. But rarther thansign on as unemployed,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondance ceased from them, circa 2001. To date  I have had no correspondance from Student Loans. I was made  redundant in 2009 and  reached 65 in 2012 , at which age the loan should have been cancelled. Now ,today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

Our first mistake was getting car repaired so that Missus could continue her care work,she's a mobile carer.

So fifty quid fixed car, which meant fifty quid couldnt do poll tax.

Being as the account is in equitalink3.gif hands we couldnt carry agreement and pay extra ten per month

Yesterday we had the get in touch letter as we rolled up today and you weren't even in

We did the phone calllink3.gif because the letter threatened absence removal of goods

Today she rolled up for her 280 pounds told us our attitude stinks and warned usshe was acting on our behalf even diong us a favour by wrapping up account one so she could concentrate on account two.

She warned us that if we didnt keep up payments she would be around again and would start with the car and work her way into and around the house.

It was pointed out that we want to pay our debt are not refusing to pay our debt but sometimes things happen to which the reply was

MANAGE YOUR MONEY BETTER MAKE SURE RENT AND POLL TAX ARE AT TOP OF LIST

Fraid to say this is the attitude of all bailiffs male and female alike.

First off have you ever let her into your home, If not then keep her out.

make sure all windows are securely closed as bailiffs can enter through a window and only talk to her through the door if need be.

Dont be intimidated by what they say, there is a lot they cannot do but say they can.

Did they start of collecting both debts at the same time

have already done a levy on the car for any/both accounts

Is the car on HP finance

did they leave you a notice of seizure of goods and inventory

have you had a breakdown of fees for both accounts

 

have you had the amount of both liability orders (confirmed by the council)

do you know the dates both liability orders were sent to Equita

We tried not letting her in but it got to the point where she says if you dont let me in I wont register your payment to me and I wont restart your agreement.As you might have guessed we are very green and sound wet but with the heart problems between us to get worked up becomes painful and then in some cases it means a couple of days to recover, so really its a loser all round for us.

OK so she has levied goods in your home

can you list what she has levied (THIS IS IMPORTANT) as there are goods they are not allowed to levy

 

did she only levy once

have you had a Breakdownlink3.gif of fees for both accounts

 

have you have the amount of both liability orders (confirmed by the council)

do you know the dates both liability orders were sent to Equita

 

I know its a lot of questions but the more info we have the more we can help you check every thing out to see if its all above board

 

Bailiffs are very very good at charging fees they should not and levying goods they should not etc(one of regular contributers on here has just help someone get £1500 removed from accounts most of it bailiff fees )

 

Post up a bit more about your heart problems Rae one of our regular posters will need this to help you write a letter to the council to try and get the debt sent back

Its unfortunate that you have let her in but dont despair, You have a heart complaint, are you on any benefits at all.

As hallow has pointed out we may be able to get this back to the council due to that fact.

What she has levied is very very important so if you could post that up that would help a lot.

It was also help if you could let us know the charges that have been placed on your account this far.

Like seanamarts, I'm very interested in your heart complaint(s). Could you elucidate a little? Are you on medication? Under a GP / Specialist / Other NHS Healthcare Professional? Receiving disability related benfits?

Sorry for the delay getting back but I volunteer a lot for local housing group. First off Ive got heart failure,2candersartan,2 blue and a half brown warfarin,1bisoprolol,1furosemide,1digoxin,1lipitorartorvastatin, the missus has had to heart attacks and a triple bypass with added mrsa .I'm on incapacity she works.

Those who might be considered vulnerable include the following:

the elderly;

people with a disability;

the seriously ill;

the recently bereaved;

single parent families;

pregnant women;

unemployed people; and,

those who have obvious difficulty in understanding, speaking or reading English.

 

The list is not exhaustive and there may be other boxes you tick.

 

In my view you need to write to the bailiffs informing them of your medical conditions, provide supporting evidence. Copy letter to Head of Revenues of the appropriate council. Send by signed for...

Had another letter today the council have gone to court sometime and passed another 666 quid to Equita, which is required return of post.I rang the very nice switch board person at Equita and asked could it be put on the deal that has been since paying the 285 and she said no , because the fact that they cocked the names up they addresed corespondence Mrs&Mrand First and family name and todays is Mrs&mr Wifes first and husbands first and family name at the same address and postcode the 2 are different and it cant be done so i said how are you gonna get 660 quid out of nothing, to be told stop being awkward and she put the phone down.So it looks like all day in the polltax queue today and find out why werent we invited to go to court or even notified that they were going to court and then i might go and cry my eyes up in CAB and hope I can see someone mature and not a whizz kid who hasnt a minute to live he says without wanting to sound ungrateful

Hunni, you cannot talk to bailiffs. They will lie, cajole and intimidate. The only thing they want is your cash. And as much as they can get. Make a note of the conversation. Click the link in my last post to the National Standards for Enforcement Agents. Scroll up and read it all to learn how a bailiff should act. Then use the conversation you have had with the bailiff plus quoting from the standards as a basis for a Formal Complaint to the CEO of the relevant council. Also include your health conditions and supporting evidence.

Do not bother contacting either bailiff or council by phone. As a matter of interest, many councils outsource their revenues queries to Capita. Who happen to own Equita. You get the picture...

Always write and keep a copy of correspondence. Send all letters signed for. Mark the Formal Complaint 'private and confidential' and address the CEO by name [usually on the council website].

Contact your local councillor for assistance.

As a medically vulnerable household this debt should have been taken back by the council. The bailiff is fully aware of the National Standards but will choose to ignore them as long as possible.

You need to recognise you are working from a position of strength and have the moral highground...

Normally I'd volunteer to draft out a template for you but, with apologies, I'm a little sidetracked by my own health issues. [And those apologies go to all on CAG who are vulnerable, I really hate neglecting this]. But I have to find out why my legs don't work like they used to - and I suspect they're out of guarentee! At the moment medical thought is leaning towards arthritis in both hips. Doh!

If you feel so inclined and have a half hour to spare tomorrow do the following:

Click on my user name, click on 'find all posts' - I know there's a few - and have a quick scan. I know I've posted a couple of CEO complaints recently. They are usually a MS Word attachment [so look for threads with a paper clip]. This'll give you an idea of how to write them and the style I use. Some of the phrases are there for a particular reason.

i hun sorry your having to deal with these horid people ive had dealings with them to and they are as horid as every other bailiff i have a problem with a bailiff to u can see it under police let bailiff into my house it was also for council tax ive gained lots of experiance since monday from been on here and speaking to cab just one thing Dont Open The Door To Them They Will Force There Way In but let me no who your council is that they are working for and what time they arrived at your house as with my council there have time restrictions on when they can collect for tax

Hi Vicki202, I have to say Equita are the biggest bunch of neanderthal bullies I've ever had the mispleasure to meet. That said, that experience is one of the reasons I'm here banging me little drum for the vulnerable. Hope they appreciate it ... :p
