      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent my SAR to the Ulster Bank on 6 August, received a letter on 23 to say that they were dealing with my request. Has anyone actually had a good response from the Ulster Bank and received their charges back???

Hi Kibby

 

From my experience I would guess you'll get the info requested about 40 days after the 23rd (the date they wrote to you.)

 

If you already know what the charges are, you won't need to wait for their response. Just send them a preliminary letter (use the template on this site) requesting these back.

 

Give them about 2 weeks and if you don't get a favourable response, send the letter before action.

 

As far as I can tell, no-one on the site has got to the stage of getting their charges back from Ulster, but a few are further along the process than you or I.

UPDATE -

I checked my online claim and as yet hasnt been acknowledged. I might just fone and check that it was resent this time as last time it didnt go. Its a week today since it was last sent so fingers crossed i hope to hear something soon.

 

Will the bank answer through the court service or will they send me a letter??

My Claim Was Successful!! Got My Letter Yesterday And They Are Settling In Full As Long As I Write To The Court And Withdraw My Claim :):):D :D ;) ;)

Thanks, still cant believe it. Just hope i get the money before xmas!! I have all the necessary letters done and am posting them today so heres hoping!

Ulster bank say in their letter that before u get ur refund u must say that u r not goin to be lodging any claims in the future and that u must not tell anyone!! Well i aint gonna bother with the latter people deserve to get their money back. If u have more charges then why not try phoning the bank i got 2 charges applied last week and when i foned up i got them refunded no prob,

kibby i spoke to a clerk in northern ireland court service he told me that ulster bank are putting conditions in settlements and he said the claimants dont have to accept them ie. not to claim again and keep your mouth shut wonder what their reaction would be if we put our condition in that we wouldnt have to claim again if they agreed not to charge us again ????

Just cross out the conditions when you accept the payment. Can you let me have your claim number, amount and date you get settlement for the Litigation Concluded forum please, and complete the survey.

Hi folks,

 

I posted off my SAR to Ulster Bank on 30/10/06 by recorded delivery including £10 fee (cash), and as to today, I have received nothing from them yet. I have even tried tracking the recorded delivery via royal mail website, nothing.

Should I just send a letter of Data Protection Act - Non-Compliance template 3 as per bank templates library?

 

Any suggestions would be greatly appreciated. Ps, I have calculated my charges and already have them typed out.

wherever you sent it to i would think although my mate sent his to his branch, head office wrote to him but he collected all his statements from his branch bit daft i know but thats how it happened !

Hi all,

 

I rang the bank today and spoke to Mr. Stuart Martin (DPA Manager), having explained the situation to him, he agreed to look into it as they were getting a lot of cases coming in and would ask Mr Sean Mc Greevey who handles all claims and has set up some sort of spreadsheet system to log in all cases etc arriving. He told me that he would look into my case and either he or Mr McGreevey would ring me back within an hour to give me some sort of explanation.

True to his word, Mr Martin rang back, only telling me that they were unable to locate anything and suggested that they did not receive anything at all. This might be correct as I am unable to get a delivery date for the Recorded Delivery off Royal Mail website. Anyway, he asked me if it is possible, would I agree to forward another SAR and they would act on it whenever they received it, I agreed to this and so now, I will just have to wait and see.

Guess what, i found my receipt for Recorded Delivery, checked it on Royal Mail website and it was delivered by Belfast office on 07/11/06, I have also been able to print out a copy of signature.

This changes things, now I am re-posting SAR along with a 2nd page added stating that as they have failed under the DPA to forward my details within the 40 days deadline, I have gave them 14 days to reply this time (too generous maybe). Let's wait and see, I will keep you posted.

PS, sorry Kibby for taking up your thread, i am unable to find how to add my own thread for Ulster Bank.

Thanks shovey for the reply, I meant to ring them today again, but just didnt get the chance, anyway, I have re-posted the sar and have given them 14 days to forward my details. I also explained that due to their incompetency,after 14 days, I will proceed with LBA and then court proceedings without any further corrspondence.
