First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was made redundant recently and as you would imagine the repayments have come last compared to mortgage etc. They havnt been paid for a couple of months and sent through the obligatory default notice (with the same errors as everyone elses) they tried phoning a couple of times which I didnt answer, but I did however send them a letter offering 100 a month till i find new job. I have heard noting about the letter I sent but have now received a demand from lewis group. I have paid over a third and it is on HP. What happens now? does this mean that the HP agreement is void and they are chaising me for the cash or is the HP agreement still active?. The car has cost me about 3500 in the last year on repairs alone and I was hoping they would repo it but now this letter has arrived. Any help appreciated.

The Lewis group is part of welcome and they work together to put as much pressure on people to pay as possible. Did your letter from TLG demand full payment?? Cos if it did I'm fairly sure that is considered as termination, but please double check with others first.

Unfortunately, as you've been defaulted you can't VT now, so basically you're stuck with the car or you can give it back and then still be liable for the remaining balance but have no car!

It's not impossible that they will repo illegally, I mean it wouldn't be the first time!!

thanks for the info, yes the demand was for full payment. Does this mean the HP agreement may now be terminated. I took mechanical insurance with the car and they have never paid out on anything and now I have been told that the warranty does not cover vehicles over 100K miles so I am being charged for insurance which is no longer valid. Any advice on next step.

Did you have PPI? If so have you tried to claim on it??

As far as I'm aware, if they demand full payment this means the agreement is terminated as they are not allowing you any further option to pay by instalments, but please double check.

 

What nonsense about the mechanical breakdown insurance!! :mad: Have you got any terms and conditions relating to this??

 

They can't repo without a court order if you've paid more than a third, and if the agreement is terminated it means that your obligations to pay your monthly payments is gone but they will still chase you for the remaining balance :mad:

Im a litle confused because the total they are pursuing is for the balance at full term, so they are chaising for the 2 years of interest which is would be due if the loan went full term. Is this correct as if they received payment from me of the full amount now there should be an early settlement figure taking the interest into account. Sorry a bit dense when it comes to loan agreements etc. Should welcome inform me that the agreement has been terminated because at present I have no idea whether still in force or not.

was the mechanical breakdown through direct group as welcome usually use them

 

firstly i would suggest contacting them to confirm any insurance was in place to begin with

 

secondly i no doubt you will be harrassed for full payment as welcome offer very little rebate even if you settle half way through your agreement

Yes insurance was with direct, will check whether in place or not. Does everything stack up though, faulty default, no termination notice etc. I have read other posts about chaising welcome, but this seems to be a new tactic by them.. Does this mean there is no form of redress for their errors etc. Is this the end of fighting welcome.

I was pushed into mech insurance by dealer but ppi never came up. The car thermostat died 5 weeks after buying car and needed about £1000 of work doing to it to get it back on road. Since then i have forked out another 2k keeping it on the road. I contacted welcome to claim on breakdown insurance but they told me that it wasnt covered. I complained but needed a car so paid for myself. Since then have been told the insurance is now void as i have done over 100k miles. I have all paperwork etc, but have never received a termination letter etc. I was looking forward to a fight with them but now I fear they have bypassed the repo route.

I am going to do an HPI check on the caron thursday when I get some money, if this shows clear of HP can I dispose of the car or would you advise against this. The MOT is due soon and will cost I think a small fortune. What would you recommend as even if I could still go downthe VT route I think they will sting me for all the repairs. What is best to do.

contact direct group i doubt they will be very forthcoming but if you do indeed have a policy you can check what dates you are covered from/to!

never an end to fighting! dont give up!

if they havent issued a 'compliant default' they have chance to issue and reissue until they do issue a compliant one if you get a termination before you get a 'compliant' default then its game over for them once they have terminated they cannot issue another default!

you at least need to be claiming back these useless insurances!

 

have u ever received documents and terms and conditions from direct regarding insurances?

 

they havent bypassed, if they have they have screwed themselves anyway and 'shouldnt' take the car they do seem awful slow to be 'lifting' the car is there a reason for this ;)

Only paperwork received was welcome booklet about mech insurance never anything from direct. The only thing I can think of why not lifting car is because i had paid more than a third?. Any ideas.

in my opinion they dont want the car the debt is far more valuable

 

its not right

 

i bet they can sell your debt for more than they can get the for the car

 

subject access requst them to truly find out what they have screwed you for then go get them.

in my case direct group will send you insurance documents

Sorry for the lack of responce been away for a few days. I have now done a HPI check on the car and it came back clear of finance. Its MOT is due soon and will cost a fortune, does this mean I can trade in for another car? Will this hamper my fight with welcome. I am willing to fight the debt collection co because of defective paperwork and lack of termination letter but can I still fight this if I no longer have the car. All advice welcome.
