      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello Sod'em. I've seen your username on the other forums and have always rather envied it. Wish I'd thought of it first. Welcome to Benefits. Are you really suprised at the responses? We have some great people here.

 

Please can I add my sympathies and outrage about what's happening to you? The physical things sounds capable of being understood even by Atos, but I've been there too and I would suggest as others have, that you view it as the first step in a campaign. No-one knows what Atos's agenda is exactly, but I have a jolly good idea what I think it is.

 

Having experienced mental problems myself, I would encourage you to seek specialist advice, probably a consultant psychiatrist to start with, who may refer you on to the appropriate professional. But having a consultant on your side is worth something for you appeal, and should aid you on the road to recovery. However nice your GPs are, they don't have the right qualifications. Mine would have prescribed me the wrong medication completely if I'd let them. I don't suppose your professor has a colleague in psychiatry he could talk to for you? Otherwise, you would go through your GP.

 

I'll have a look around for the descriptors which you'll need later if you appeal, will be back later. If I go and try to come back now, this post will disappear.

It's possible you left it because you weren't ready to accept what has and is happening to you. My OH doesn't listen half the time anyway, but I don't think he has PTSD yet. :) Mental illness in my opinion is harder for anyone who hasn't studied it or experienced it to understand. Because it can't be x-rayed or measured, that seems to cause problems.

 

I have to say, and your GPs are probably lovely, that some of the advice sounds not far from 'pull yourself together', which is never helpful when one is in mental turmoil.

 

Don't rely on a support group, I agree. You want someone who will fight for you if necessary, and a proper diagnosis that you can wave at Atos should you need it.

 

My NHS psychiatrist was a tiger when it came to defending me, don't know what I'd have done without her. Well, in a way I do, I might not be on this forum now.

Hi guys. I will read it in depth when I can, but banging the drum on behalf of those with depression and anxiety, there seems to be little or nothing dealing with the conditions I'd say we come across most here.

Crazy, isn't it? Paul is right though. Pretend you're Robert Redford or Brad Pitt and do the ill bit [i hope you're male, if not very sorry] and whatever you do, don't try to be brave.

 

Have you swotted up on the Brighton Campaign people's analysis of how LiMA works, because I think you must. The more I think about it, the worse it seems. Grrrr.

 

But it's not the end of the world as we know it after Monday, there are appeals, so don't go getting all nervous. Before you go in, take a deep breath and say to yourself 'I can do this, I deserve it'. [sod'em, as one of fellow caggers says it.] 'And I have who knows how many caggers behind me, so there!'

It's a bummer Sod'em, and best wishes and big hugs from me too. So you'll be going to appeal will you? From what I know and from posts on the forum by Loan Ranger, sadly nothing to do with Atos surprises me.

 

When you feel more able, we'll help you put your appeal together. In the meantime if you break something, don't let it be you.

Hello sod'em, I'm really sorry to hear that.

 

As you say though, you have a lot of ammunition against the assessment. I think appeal is the right way to go. Mental health problems are badly catered for at Atos, as we know, and anyone who hasn't suffered can think you're making it up because they can't x-ray you for it. That's how I felt, anyway.

 

I put a sticky on the forum that has helped two other people win at appeal to a tribunal and Erika helped me with the template. There's a link to the points system, so you can score yourself and see what you should have got.

Hi, Sod'em. I was a bit confused about appealing a decision revised in your favour too. Maybe they mean if they increase the number of points but you still don't get 15?

 

Plain English would be nice, I agree.
