    • I just meant that if they parked the other side of the yellow land that is council maintained land and they'd get a pcn.
    • Thanks DX I will have that uploaded
    • its SJPN you simply fill the form in pleading not guilty. you will then be sent a later court date by letter to appear at your local magistrates court or the DVLA will might even drop the whole case. if you want ,fill in the small section of the form too, simply stating that payment for said road tax was cancelled and latterly reclaimed as a new DD was already in place. hence i double paid for said disputed period of the claim. just to be 1000% sure. please scan to PDF the page that states what you have been summoned for.  read upload carefully
    • HI DX Yes check it every month , after I reinstated the second DD I was checking every week. Also checked my bank statements and each payment has cleared. When responding to the court claim does it need to be in specific terms ? Or laid out in a certain format? Or is it just a case of putting down in writing how I have explained it on CAG?

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had an offer of partial settlement but they have rejected that I am currently suffering hardship. I am replying to them using letter 4 of the refusals template. I also submitted a letter of appropriation but Lloyds then said they would only appropriate once and would then close my account. :!:

I am currently on benefits and am disabled.

What was the basis of them refusing your request under hardship ?

Have you got anything in writing from them ?

Did you send them evidence to prove your circumstances ?

Hi, I have scanned ion their reply Are you able to read it? They are not denying I am in hardship but are saying they will only give me some of my charges back and will only let me appropriate my money for 1 month and then they will close my account 30 days later.

I went in to see a Bank Rep as this site advises and he went and got their procedural guidelines which are they will appropriate once and then close the account. I am trying to do 2 things here get my charges back and try and make sure my benefits payments are used to feed me and my children. I pointed this oput to the poor employee who met me. He said he would check back but so far I have heard nothing. I need to write up the meeting and confirm as advised here.

However I pointed out that as a Bank owned by the tax p-ayer I woulkd expect them to operate in the spirit of the law.

I have been a LLoyds TSB customer for 34 years. I am shocked at how ammoral they are.

I also sent them my budget prepared by CCCS which clearly illustrates I am broke following redundancy. I was assaulted at work, went off sick, became disabled due to anxiety and depression tried to get back to work, when I did they made my role redundant 4 months later. I told the Bank the whole story.

Hi,

I'm sorry to read of your situation, your scan of the letter you received from the Bank does not show, could you try to scan it again.

Regards.

If there is evidence that they are threatening to close your account because you are seeking charges back or else exercising right of appropriation, then you may have recourse to file a complaint and seek compenastion from the regulators.

I am flagging this up for site team thoughts.

Thanks, I'll rescan the letter which clearly says that is exactly what they are threatening. Basically they said, and my local bank had the exact same policy document, we will let you appropriate for one month and then give 30 days notice and close your account. They also want me to specify exactly what the money is to be used for they say a budget showing all my incoming and outgoing money is not acceptable.

Yes they are within their rights to ask what appropriation is being applied to what.

You should have listed those in your application/ROA letter.

Your income and expenditure sheet SHOULD be acceptable what are they on ?

Bankfodder has written a guidance article on appropriation on the front page.

Interesting.

The FSA ave issued guidance as to how letters should be worded ?

No wonder these are all looking the same then.

I note also that they say right of appropriation cannot be used if a charge has already been applied to an account-this obv is not so clear cut.

A charge can be applied after a breach but is not actually taken until the day notified.

Since many would not be aware of the charge until they got the letter advising that charges will be taken-so does this mean it is too late to seek ROA at that point ?

I have now had another letter from Lloyds saying'

As we mentioned last time we have consideredany points you raised in your letter as well as all the information we have about your personal circumstances.

In relation to your complaint we are happy with the response we have already given.' They then refer me to the Financial Ombudsman Service
