No harm in waiting the 48 hours, you have enough time before the eviction date so even if they don't accept your proposal you can still send the letter with the cheque at the end of the week and put the N244 in next Monday if need be.

OK, we'll deal with whatever they come back with. Try not to worry too much - I'm sure if it went to court and you produced the repair bills for the equipment and proved you had paid a lump sum, the judge would be OK with that.

hi all

got a call from capstone this morning rejecting my offer .. they want more of a lump sum and for me to up my offer of 300 extra per month .. they say i have more disposable income . I asked them to put it in writing that they had declined the offer and she asked why .. i said i would like it as evidence if i have to go back to court .. she said ok she would do it .

about 2 hrs later i got another call from her and she said that they could not put it in writing as all offers are made and accepted or decined verbally .. asked if i had thought about upping my offer .. would i be contacting them in the next few days or was i going to go down the court route ... i answered that i wolkd have to get advice on wat to do next and she was very interested in where i was getting my advice from ...

None of their business where you're getting your advice from ! Send the £2,000 cheque at the end of the week and I'll do you a letter to go with it. We can then enter the N244 at court next Monday.

 

Why do they think you've got more disposable income? have you given them a budget sheet?

she went through a budget sheet over the phone and i told her my son had just started work last week and she asked if he would be contributing .. i said he would in the future .. she included the 30 per week from him ... he is yet to be paid and only in his second week of work ...

also do you think its possible to get them to decline the offer in writing just in case i need to show the judge .. she said there solicitor would inform the judge that they had declined it and not to worry

We will state in the letter to go with the cheque that you spoke to XXX on 19th October and they informed your offer had been declined. I've affixed a budget sheet for you to complete to go with the N244 (and also the letter). I'm sure that when she went over the budget with you on the phone she won't have included all the categories on this budget sheet. Make sure that the amount you are offering to pay towards the arrears each month is the amount left over after everything else has been accounted for. If you want me to look it over let me know.

Hi, letter to Capstone affixed. You will need to enter the addresses at the top, the mortgage account number and the cheque number at the bottom where I have put XXX's.

 

Don't forget to write your name and address and mortgage account number on the back of the cheque to make sure it's applied to your account. Take a photocopy of the front and back of the cheque and also a copy of the letter. Send by special delivery and keep the receipt safe with the copy of the letter and cheque. Make sure you print off the signed for receipt from the royalmail website a few days after posting and staple it to the copy letter. We will need this to go with your N244 application.

I think you'd be safe to wait until Tuesday or Wednesday next week to see if they ring after receiving your letter. I will draft a statement for the N244 so it's all ready to go - you just need to complete the budget sheet I gave you.

 

If they ring in the meantime stick to your guns, tell them you are paying £2,000 on Friday plus £1,300 on 4th November, also you can't afford any more than £300 extra per month and you're happy to let a judge decide if your offer is fair.

 

How much are the arrears in total?

Are you saying they're taking 115 each month off what you are paying towards the arrears?

They can't do that! what you pay extra each month should be reducing the arrears by that amount. Have they included these charges in the arrears total they claim you owe?

 

Have you got statements showing all these charges?

OK. take a photocopy of the statements and circle every £115 in red pen - add them up and total at the bottom of each page, then add all totals together. Let's see how much has been added in fees against how much you have paid towards the arrears. We can use this with your N244 also, to let the judge see that the arrears figure they claim is not correct!

hi .......... all done letter and cheque sent of recorded delivery

now we wait ......

i didnt sleep much last nite wat if they dont agree ,wat if the judge doesnt suspend

do you think i should offer them more money as a lump and up my payments a bit?
