Hi. I'm working full time and i've not long got off the phone with my employer who is family about holiday pay and i asked him could i take a week's holiday as im going on holiday in a few weeks.. He's turned round to me and said " Your holiday pay gets added on to your monthly wage " So he's more or less telling me im not entitled to it. I didnt have a clue he was adding it on to my monthly wage is he allowed to do this? I never get payslips and when i do there wrong they tell me ive earnt more than ive actually had!!!!! Any help would be much appreciated so i have some info that i can come back to him with..

Hi Sam,

 

Your employer seems to be practising 'rolling-up' holiday pay, where your holiday pay represents a determined percentage of your hourly rate.

 

This practice has been ruled illegal... it breaches the Working Time Directive because payment for holidays is not made at the time the holiday is taken...

Hi Sam. I think you should be receiving payslips, according to UK law. Are you saying that you are working for a family company?

 

Do you have a contract of employment that says what your holiday entitlement is?

 

I think you need something in writing, otherwise how can you work out what you're receiving? I don't know if holiday pay can legally be added to your pay, but if you have received the money, then it's not necessarily unfair, I would think.

 

A quick question please, you say that you never receive payslips, but then you say when you do you think they are wrong. If they say you've earned more than you thought you did, could this be the holiday pay? Or is it the amount earned before tax is deducted?

Thanks for the reply's. Yes he's my dad's brother. My payslip for last month is completely wrong and last year i only ever recieved 3 payslips he tells me he'll email them through but they never seem to get to me. The pay period dates are wrong and my payslip tells me ive earnt well over £2200 when infact it was more around the £1300 mark after tax. The pay YTD is telling me ive earnt £14000 in just 1 month!!!!! He does it from January - January.

 

So it is illegal then if he's been paying me my holiday pay on top of my monthly pay without telling me?

 

What should i do?

Delicate position when it involves family members...

 

If he is your dad's brother, that makes him your uncle... ok!

 

Just tell him that holiday pay should be paid when taken... and that the practise is operating is illegal...

 

When it comes to your pay-slips, as 'honeybee13' mentioned, you are legally entitled to itemised periodical pay-slips...
