    • I drove a friends a car for a few days and I used cuvva car insurance to insure myself for the time period. Here's the problem: I made a mistake with the dates on the insurance, I ended up driving uninsured for one day and I got a speeding ticket. My friend named me as the driver on the Notice of Intended Prosecution as she should and I will take the blame of course. Will met police ask for proof that I was in fact driving? I mean, any more other than me replying to the NIP that I will soon receive from them? Cause I assume that my insurance for the day will be the proof that they need... Secondly,  if caught driving uninsured, what will happen please? I read it's £300 and 6 points. Is that all or is it worse? I'm only asking for information from knowledgable people. If you intent to just mock, you're certainly not helping. Thanks

    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but cannot be sure. And without having an account I can't check either. But, I know that I did properly declare the item and a value that reflected its then retail price - I was concerned this declaration may have been used to single the item for theft. But now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through your huge document store of information, in addition to MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I have just had someone come to the door who I ignored cos I thought he was a salesman.

 

He returned to his car and returned with a postcard in an envelope and pushed that through my letterbox.

 

On the card it says he was a 'representative' from IQOR and

they say they are collecting on behalf of capital bank?

I don't know who they are?

But I am guessing by the debt amount it could be Halifax if someone can clarify this please?

 

It is for a very high amount ££,£££'s and there is no way of me paying it back

this is a bit of a panic type post as I was not expecting having an unvited guest interupt me this evening.

 

If capital bank = Halifax then It's a fairly recent loan (2008 ) so not sure what to do.

 

Should I just send them the no door step callers letter straight away for now to stop them returning while I think of what to do next?

Never had a store card. My car finance was with GE money and now with Santander. I doubt it is that as I don't owe the amount on the postcard nor is it in arrears so they have no reason to send someone to my door about it :confused:

 

The only figure I owe a large amount to anywhere near as high as the postcard is a halifax personal loan but Iam not even sure if that figure matches up correctly :confused:

so wait until they write, if the idiot turns up again just send him packing, they cant just arrive without prior contact, I would also send the postcard onto the OFT and complain that they have not made prior contact nor asked your permission to visit

You need to send them the "deny debt prove it" letter which is in the templates and also add the standard paragraphs about only communicating in writing and not visiting you at home.

 

Out of interest, haven't you received any notification of a visit from this company previously?? If not, then I'd take a look at the OFT guidance and lodge a formal complaint.

Thankyou for the above.

 

They never sent anything to say they were going to visit.

 

I really am unsure what this debt is as the only thing I have ever had with GE money is my car finance which is up to date with payments.

 

I need to go to work right now so I'll do the letter to them in the morning saying I do not acknowledge the debt and to stay off of my property :mad:

 

If anyone has any furthur advice or could help in what I should send to the OFT to complain about my unwanted visitor then I'd be grateful and I'll reply to you in the morning.

Hi avocados

We have received a letter from Iqor regarding a Capital Bank debt and it does related to a Bank of Scotland/Halifax Classic Credit Card.

I must admit it did puzzle us at first until I checked the account numbers thats when we realised it was BOS. As it did state on Iqor letter Capital Bank which we automatically thought GE Money who were GE Capital at one time. But I can assure you it does relate to BOS/Halifax.

I am considering taking a leaf out of their book with a reply similar to this:

 

Thank you for your letter addressed to +++++++++ however, this person no longer exists, having married and changed their surname. however, they chose not to take the surname of their partner, but rather revert to their Mothers' maiden name. Again, that has caused further confusion in that they were getting their grandfathers' mail and have therefore changed their name entirely by Deed Poll.

 

I am sorry to say therefore, that due to the confusion caused by the change of name of the company you say you represent and that of the supposed receiver of your letter, no certainty can be acknowledged that there is any relationship between either parties.

I've had a sleep on it and I am fed up with the whole debt situation, if I was single I'd just go for bankruptcy and they would end up with f##k all as the house is bordering on negative equity or exact amount owed at best anyaway. But I know that she'd be gutted if we lost the house and it's the only thing that keeps me going sometimes.

 

I really don't know what to do about it all, I suffered from mental health problems years ago and it's hard to keep level headed when you have these b#st##ds phoning you all day every day, writing threats and turning up at your door. It feels like I'm on the verge of another break down sometimes.

 

I really am stuck at what I should do about it all, I have zero assests so they can take me to court and will still get eff all from me.

 

Don't know if to go down a DMP route but don't you have to pay those for tens of years, years, years and years? whilst a bankruptcy only lasts 6 years then you can start a fresh again. Of course I have thought about the 'other' option very seriously but money is not everything (apart from to bankers and DCA parasites) and is not worth ending it all over.

For these "people" send the letters as advised above.

 

The harassment letter and the doorstep letter asap! Get the calls stopped. And make sure they don't come back knocking.

It's not going to solve all your problems, but it will be one less worry and give you breathing space to decide your next move.

 

 

Start some threads in the appropriate forums to see if there is any other help you can get, before taking on such a big decision of bankruptcy.

I have printed the letter off and i am off to the post office with it shortly.

You can still CCA for a loan....but one step at a time...let's see what happens in response to your first letter.

Chances are it will be for Halifax. I have heard a lot more Halifax debts being chased by these lot.

Despite me sending them a letter stating that communication must be in writing and that I do not know of the debt, guess which muppets have just phoned? :evil:

 

All I got was a letter saying they will investigate my complaint but the harrassment still continues

It's rare indeed that they ever actually take any notice of a letter :rolleyes: If they continue to harass you, report them to the OFT, as they are in breach of the guidelines by not using your stated method of communication.
