    • retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free  I hope dpd will refund them so they don't lose out. Will keep you guys posted. 
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

iv been keepong all correspondence from all of the collection agencies for the past year ,many are confusing, many are letter cycles

 

i have about 12 files going on with each agency and each debt

 

Good starting point then. So you can probably get a few threads going.

 

If you've been reading around you will have noticed the importance of Default and Termination Notices. Get them scanned and posted up as you may already have won on a few of these and don't realise it.

 

Do you have any docs by the way for this thread. Default Notice in particular.

Look for letters headed Default Notice (served under S87 of the Consumer Credit Act 1974) or words to that effect. These are very important.

 

Also, if you have had any subsequent letters confirming Termination. It's a starting point.

Yes, don't start doing what you cannot afford. When able, then send CCA request.

Entirely your choice, the standard of info you're looking for is, IMO, better sought in these forums. CAB advice is not always as good.

Dependant on the content of the DN, followed by subsequent termination on the back of it, you could be in a position on some of these where

a) they cannot be enforced by a court, or

b) you may owe no more than the arrears part shown on the DN.

Don't panic ;). As time goes on you will find that others will post on your threads. And yep, keep the BC issues on this thread only.

 

If you're looking for an answer to a question and not getting a response then just type the word "bump" in a post and put it up. It will push you up the lists of new posts and i'm sure someone will stick their head in and have a look.

Not only do you get great advice on here you also find that as we have all been through it people listen without judging (Unless of course they're DCA troll's ;))

 

You have started to get control back of this part of your life and I'm fairly sure that as time passes and results form other things will not seem quite so bad

Both subjects I know nothing about (thankfully) particularly invoice financing!! Sounds pretty specialist.

 

Try posting up a question in the General Forum by starting a new link and post your question as the title.>>> Something like A Question On Invoice Financing!!!! Then in your post ask for a link or some advice on where to post. When you get an answer i'll pop a link up for you if no one else does it. No probs. Same for the car/HP.

Something not mentioned yet seklof - was there PPI attached to this card? If you printed off any statements it will be at the bottom and will say 'Card Protection Payment' or something very similar.
