    • Does anyone know if I would be allowed to record conversations with health professionals for my own use on my phone without them knowing. I know that we are allowed to record phone calls. I do record some of my phone calls for my own use due to my disability and if anything is said then I am covered. I would only record audio in private area's of myself and the professional dealing with me. I know I could not get and other persons audio in it and I don't intend to. my only other option is to buy a body cam but I am not sure the rules regarding this.I never thought i would have to but things are getting worse Thanks for any guidance

    • Ok thanks for that, well spotted and all duly noted. Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have decided to tackle Yorkshire Bank on behalf of my boyfriend, who has been charged hundred of pounds over the years, and is too lazy to do anything about it! Men eh!!

Have sent the DSAR letter off and have today forwarded them the cheque for £10, as they require.

I am currently tackling Halifax for myself who, so far, have been quite cooperative.

How do YB seem to be at dealing with these issues? I note from the Forums that a few people have had problems with them.

If there is anyone out there who is also just starting out, and wants to track progress together, that would be greatl! :p

Thanks for your reply! I am willing to wait as long as it takes and go as far as it takes to get what is rightfully my boyfriends.

Welcome. You'll find Consumer Action Group and it's members very helpful! I'm a bit dim at things like this, but I have got the hang of it now, and there are many people in the same situation. I'm just about to post my LBA (letter before action) i was unusre about it, but when I totalled what they owe me up it amounts to £900 squid!!! So .....I'm definitely going through with it! They have my money! And they are not very nice and will try all kinds of things to put you off - but don't be. If you are unsure about anything, there is always someone here to help and advise.

Letter received from YB yesterday saying charges fair etc etc, will not be refunding etc etc. Report to financial ombusman if you feel you should etc etc.

 

LBA set to go off to them on 12th October, their two page lengthy letter will certainly not put me off! My partner does not think I will get these back for him, however I said that the letter we got was aimed to give people that impression, and that I, and all the people on this website know what we are doing so we aren't giving up!

Well, to be honest this has taken a back seat, as I found out I was pregnant, was ill in hospital and had a lenghty issue with YCC which had to take priority.

Anyway am back on with tackling YB and am starting again as such, as I can't remember where exactly I got up to and decided fresh correspondence would be best.

So Initial Approach sent today. Visa £359 Current Account £1191.

 

I know this is not going to be easy reading evreyone else's post, but am in for the long haul here!

Update. Court forms taken to Local Court on 1st Feb. Letter dated 1st February received from Yorkshire Bank with cheque for 50% of charges being £775. Have declined the same and advised that Court Action was commenced, however slightly delayed being issued due to Industrial Action. Have stated I will retain cheque until such time as full and final settlement is made, however this will not be encashed, and is not accepted as full and final settlement. Advised their offer is declined and am now only willing to deal with through Court Procedures.

 

Trust this is all ok?

I would be inclined to send the cheque back to them by registered post.That way there is no way that they can say you have accepted hteir offer by holding on to the cheque.
